UC / council tax

I just migrated from ESA to UC , I had my council tax reward E mail , calculations do I got my UC witch is roughly the same as my ESA ,housing entitlement , same as my housing benefit was , but they also got a £30.22 a week unearnable income , that I not getting by the way ,can anyone explain this ? As council tax where useless and told me it's what UC has told then

Hi,
Does that figure show as a separate element for anything on your UC statement? As UC is paid monthly it will be around £130 on there.

As per your previous thread I believe we managed to establish that you would most likely get Transitional Protection on your UC award.
I'm guessing this is what your local council is talking about.
As advised on another thread the monetary amount may be the same as your ESA, but some local authorities treat UC differently to legacy benefits.
Transitional Protection is "excess" income as another person in similar circumstances on UC wouldn't get that extra money.
I was awarded PIP last year, had I been on legacy benefits I would have gotten SDP and then migrated to UC with Transitional Protection.
But because I was already on UC I don't get any extra money.

Am I confused it ,so why would council tax use this as earnings that I have to pay council tax when there deducting it , and is this for one month, or with they take £30 every month, if it one off will my council tax be different next month?

Hello Kimmy again I confused in my payment statement it 32 pounds deducted for ESA I wasn't untitled to his that a one off, and why are council tax use that as earners per week to should I ask council tax to look again ?

Sometimes too much Income Related ESA is accidentally paid during the migration process.
When this happens it's deducted from the UC award until repaid in full.
If you contact DWP Debt Management they can tell you the outstanding amount owed, if anything.
Technically you've had excess income from ESA which may be what the Council have decided. Once the debt is repaid there will be no further deductions from your UC award, and you should definitely ask the council to recalculate your CTR.

If I am read this right the 390 pounds a month will not make a blind bit of different i I still have to pay 40%

What is the £458 for 'other adjustments'? That's adding more to your income total than the £30 from ESA.

That's likely to be the problem unfortunately. Some councils are now including Housing Element as income when calculating Council Tax Reduction. They never used to include Housing Benefit because they were paying that one, but now UC pay the Housing Element.
I might be wrong in this case, but that is what I've seen with others.

Hi Kimmy I just been on the phone to council tax again and be told they take your UC basic rate and your TP to to calculate your ,council tax and the 30 pounds with I am paying ESA pound , would charge anything, and I have to 40% , which 456 a year ,please can you tell me if this right ? Thanks for your time

As previously advised, I did suspect Transitional Protection was the issue.
I would recommend speaking to a local welfare rights organisation, they can double check your bill is correct.

In that case, your weekly income is £204. So the 40% reduction shown on your letter is correct for that. (£180-£210 income range).
