i really need some help

where to even begin

i know this is going to come across like i am only focussed on money and sounds terrible but it im struggling a lot and do not have any support

sorry if this does not make sense i am panicking and crying i do not know how i will cope

today my statement has come and i have been benefit capped and they have charged me bedroom taxed i called them and they said if i work they will lift it but i can not work right now

i think this is because i dont work and i have a 1 year old and twin 6 year olds and i had a work meeting with uc in january to ask when i will go back to work and i told them not anytime soon as one of my 6 year olds went into hospice care in december and my time is all with her they did not say anything else about it so i thought it was okay

now today my statement came and they have taken my 6 year old off my claim and said because she now does not live with me so i do not get her disability element and her child payment and they also have bedroom taxed me and benefit capped me i only got paid enough to pay my rent i do not know what to do

they said i also have to tell her dla to stop because she is in care????

    Hello Becsanne and welcome to our forum.

    What a dreadful situation to be managing on your own so don't apologise. It does sound like mistakes have been made on your UC claim. From the gov website:

    If your child is nearing the end of life

    If you have a child under 16 who is nearing the end of life, you can apply for Disability Living Allowance (DLA) for children.

    The Scope Team will see your post tomorrow and suggest how you and your family can be better supported and how to challenge the errors on your statement.

    What an awful situation for you, Becsanne, the very last thing you need to be dealing with at the moment.

    I can only hope that a terrible mistake has been made, and that it will be rectified before long.

    I'm very sorry to hear about your situation, it sounds incredibly stressful and this is the last you need on your plate.

    It sounds like a mistake has happened with your UC payments somewhere along the line so the best thing to do would welfare benefit adviser to find out what has happened and how it can be sorted.

    I'm very shocked that you have been told that your childs DLA will be stopped as DLA for children can continue even if a child is in hospice care.

    @Becsanne, I’m very sorry you are going through this.

    On Universal Credit, there is a rule that if someone in your household is expected to be away from home for more than six months, they usually should be removed from the claim. However, what counts as “absent” can be subjective, and in cases of serious illness or palliative care it’s not always clear-cut. If there’s any expectation your daughter might return home within the 6 months, that can make a difference.

    Many hospices have benefit advisers that can give tailored advice. Have you checked whether your daughter's hospice has this service?

    Also, if you were claiming the carer element of Universal Credit because your daughter was receiving DLA, and that hasn’t stopped, then regardless of if your daughter is on your claim you should still receive that carer element, which would mean you’re exempt from the benefit cap.
