Questions about my appeal

in PIP, DLA, ADP & AA

Hope someone can help me with this. So I appealed my PIP claim to the the appeals tribunal and I was sent a txt saying the DWP had until 26/06/26 to respond by sending me a copy and sending one to the court but they have not. So the question is do I have to contact the tribunal and tell them I have not received a response from the DWP or will they already know and sort it out from there end.

    Hi,

    You don't need to do anything. The DWP rarely meet these 'deadlines'. The CTS will give them a reminder.

    Ok, thanks, I was just wondering if I need to do something but good that I do not and hopefully the DWP move it and get it to the tribunal soon.

    The usual process in most court action is that if the Respondent doesn't respond then the case can be decided without them.

    It might be different for benefit appeals, but it shouldn't be.

    You don't need to inform the tribunal, but if it helps to give you peace of mind, then you can do.

    Yes I read different things on Google, some said it will be decided with out the DWP response, some said the tribunal will give them a little bit more time and some said a combination of the two, so giving them a extra week or so and if still nothing they will decide without them. So will see what happens.

    Update, still no response from the DWP, it is 3 weeks since the deadline. I have emailed the tribunal for a update to see what is going on with my case and to see if DWP have had extension and what date they have been given but nothing from them too. Getting very frustrated with no updates.

    So update just got a email for the tribunal and was told, they are passing my case to a legal officer because the DWP has not responded, not sure what to make of that. Has anyone else had this happen when they appealed there PIP claim and does it delay your tribunal hearing.

    The Legal Officer has to make sure the tribunal follows the law correctly.

    Their first job will be to contact DWP to ask why they haven't responded.

    They may decide to delay the tribunal date and give the DWP some more extra time. Or they may decide to just allow the tribunal to happen anyway.
