ESA, PIP and UC

i am just starting my appeal for esa as to there examer I’m fit for work which I’m not but if I sign on to UC I have to actively look for work , I do get pip so if I didn’t claim UC and just lived on my pip would my council look at this as my only income and work out my rebate from that.

I hope we can help you with this. Have you tried the online benefits calculator? You put in your circumstances and it tells you what you may be entitled to, so it can be a good place to start.

You will not be asked to claim UC unless you are in a full service area. Easy enough to check using the DWP web site and your post code.
If you're not then you can claim JSA and make it clear from the off that you're in a period of sickness, of which you can have up to 13 weeks. During that period you can be asked to attend appointments but not compelled to comply with a claimant commitment.
In the meantime, ask for your ESA appeal to be expedited (sped up) by asking for directions from a judge. Ideally you can resolve the ESA before the period of sickness on JSA expires.
If you're in a full UC area then the answer is wholly different.

i had Great help from the citizens advice bureau who acted on my behalf and was coming to the appeal with me, don’t EVER give up your fight as hard and as scary as it is.
