edited August 2018 in PIP, DLA, and AA
My sons dla renewal was back in May. He is 12 and he has a diagnosis of adhd. He was diagnosed 6 years ago and we claimed dla from then. Still very much managing his condition on a daily basis, he struggles with toiletting issues still and needs additional care to what a “normal” 12 year old would need, both with personal care and when he is out and about in social situations. He can’t go out and play like most of his friends do without supervision. He’s 12 soon to be 13!!!!  They knocked back his dla and payments stopped. I appealed against they’re decision by letter, where I went to to greater detail than I did on the form as advised by citizens advice. I’m just wondering what happens next? I’m furious they’ve stopped his benifit, they stated he didn’t need any additional care or help that a normal 12 year old would need. He soils him self On a regular basis and bed wetting happens most nights, all of which should fit in to the 1 hour bracket for help with personal care!! I still need to help him with his hygiene and personal care each morning and at nights. How is this normal for a 12 year old? I’ve explained to them that he has a diagnosis of adhd which they already know and just because he’s 6 years older than he was when we first applied does not mean his condition has lessened any and he’s able to do it all by himself which is just not true, if anything it has become more challenging for both him and myself. He’s approaching his teanage years and all of the above knocks his confidence which he struggles with anyway. Thanks in advance x

Hi @hazee85 and a warm welcome to the community! Thank you for sharing this with us all and I am sorry you are having to go for an appeal. Are you being moved from DLA to PIP?
You mentioned your sons ADHD, which of course is an important point when appeal. However, the benefit is awarded on how a condition affects daily life (which you have said) and this is what they look at when awarding. It is great that you went to citizens advice and they will have been a massive help. We wish you the very best of luck with the appeal and please do keep us updated!
You may find the parents and carers, DLA and neurological conditions boards to be particularly useful :)

Hi @cloe_scope no not moving to pip. It’s just dla renewal think it’s because it’s been 6 years. Sent the letter last week, so not sure what happens next or how long it will take. Thanks for your advice, much appreciated

    Hi,

There's no timescales to decisions, even for a Mandatory Reconsideration. It maybe longer this time of year due to it being holiday time though. Most MR decisions remain the same so don't expect any change at this point. If the decision remains the same then the next step after this is Tribunal. For this you'll need to fill out a form and send the MR decision letter with the form. It can be a very long process. Good luck and hopefully a decision will go in his favour at the MR stage.
I would appreciate it if members wouldn't tag me please. I have all notifcations turned off and wouldn't want a member thinking i'm being rude by not replying.
If i see a question that i know the answer to i will try my best to help.
