Something does not feel right

Hi there first time asking for any help but have been reading this site for a long time, anyway if someone can help me I would be great full after a work accident in1994 I was told to claim invalid benifit which I received then that migrated to incapacity benifit which in turn I was migrated to esa in march of 2013 ,as from the year 2000 I claimed industry injuries benifit at 30 per cent I had also been receiving dla from 2012 at both highest rates, my wife reduced her working hours from full time to 21 hours per week to take care of me ,but she did not apply for careers allowance or any other benefits up to this date, so I received the esa3 form filled it in sent my wife's payslips off which after every thing taken off she got £150 a week ,this week I received a reply saying we were not entitled to back payments because of my wife's wages and the industrial injurys we received .if we are not entitled then that's fine with us but something just doesn't seem right to me has they have not mentioned on the form anything about the dla I was receiving,sorry it's long but try to put all the facts down so if anyone can comment I would appreciate it regards jumbo

Hi Steve I have read very carefully all info regarding the problem,it is very difficult to sort out, I had a similar problem with wtc in 2012 the told me I was no longer entitled, but because I was on highest dla both parts and my wife was working 16 hours it turned out we were entitled to wtc,but I had to go through two higher managers to get there own rules over to them ,it just the ordenery screen reader you get through to on phone ,this is what happens when you get shot of experienced civil servent any way I'm gunna appeal it on the fact that we were on very little money with a big payment mortgage and all other outgoing we had will let you know thanks jumbo

Hi,Your DLA isn't counted as income and is not means tested for your ESA. All those that transferred from IB to ESA were placed onto Contributions based ESA.To claim the income related top up you claim as a couple because it's means tested. As your wife works 21 hours per week then anything she earns that's over £20 per week would be deducted from any income related top up £1 for £1. The income related top up on your ESA is £16.40 per week, from April 2018, less in previous years. Your wife's wages alone would most likely reduce the top up to zero.Industrial injuries benefit is also counted as income £1 for £1 for the income related top up on the ESA.This means that DWP are correct because your wife working and the industrial injuries will definitely reduce the top up to zero, which means you're not entitled unfortunately.Thankfully, claiming Contributions based ESA isn't affected by any of the above, so you are better off by £110.75 per week, otherwise this would also be reduced to zero.For your wife to be able to claim carers allowance for looking after you then she must work less than 16 hours per week and earn no more than £120 after deductions.Hope this helps make it more clear. DWP don't explain things at all.I would appreciate it if members wouldn't tag me please. First of all hello poppy and thank you for the great work you and your fellow advisors are doing for people like me and others,I thank you for your advice and I will now look at it like this what you haven’t had you do not miss and I’m happy with that. So thank you again . Can I just ask do you think my wife would be able to claim for career allowance, as it has become nessesery for her to retire from work just 2 months ago and she will be receiving a pension of £94.00 per week when the nhs pensions sort it out,they are about 3/4 months behind at the moment. She dose not or has not applied for any benefit as of now but do you think she may be entitled to the careers allowance for looking after me thanks for any advice you can give regards jumbo

You're welcome. I would advise that you both make an appointment at your local CAB for a full benefits check regarding what your wife could claim. This way she'll be able to tell them all of your details and they be able to advise accordingly.
