Assessment Notes Back with errors what next

Had F2F PIP2 notes from DWP back today, full of errors, some serious and I don't know what to do, we had a DWP disability Analyst medical all good and correct, the notes from face to face are at odds to the doctors report, the nurse has claimed my partner could move in all directions and has list angles and range, all incorrect, I watched as noted when asked my partner could only raise her leg around 35% because she had put her back out when she fell at home, its listed in the paperwork as 70%.
According to the other results she put her hands behind her head, raised her arms and managed to perform as normal, none of which happened.

As a result of an operation she continues to suffer facial spasm which render her unable to speak, so I had to speak for her around 60% of them time, its listed as "Normal facial expression" "interaction normal" "adequate rapport" "speech content normal" "did not require prompting"
When effected the right side of her face contorts and locks the jaw and eyesight is effected during this she has no control until it stops.

I am concerned as this gives a totally different picture, I am wondering how can an inaccurate nurses assessment over rule the DWP own specialist? I am wondering if we should seek another doctors report, but I expect it would need to be DWP approved.

While explaining why she was like this is was clear the nurse had no clue about the problems, looking at the descriptors and marks it looks like someone else.

    Just send my appeal off can’t belive what the assessor wrote the appeal came back saying the assessor had no gain by lying!!! So now I’m car less and waiting for tribunal date ?

    @madquasimodo Not sure what you mean by PIP2 notes? Do you mean your assessment medical report or the DWP Decision letter that says what rate of benefit they are offering your partner? Anyhow sounds like you've seen the report after the face to face and it's that you're not happy with? Sounds like you had my assessor as the same thing happened to me. If you've received the  decision from DWP you can start by ringing them and asking for a Mandatory Reconsideration. If not wait until this arrives although you can be preparing for it by going through the PIP discriptors (activities) and comparing them to what the assessor said in her report. An MR has to be in writing and sent to the DWP within 30 days of receipt of your partner's decision letter. You can also make a complaint again by letter to the company who did the assessment. Your appointment letter will tell you who this is and which address to write to. Hopefully you will get more advice from other people. Assessor's should not be allowed to get away with behaving in this way...

    Received the award letter show what was to be paid, asked for assessors copy of the PIP2 it was a review from an existing claim however when arriving we were told "computers down we have no notes on your case, we will start with a fresh claim" seems to be normal for this, I feel this was wrong as all the doctors and test results plus rehabilitation details were not present.
    I did phone and see if they had the proper paperwork Louise told me no, no, no, to any of the reports or doctors letter, double checked the following day and Claire informed all the letter and reports were in fact there and the decision was based on the new PIP2 , MR request by phone refused, told to send the request in by mail, I am aware it should be accepted by phone it says so on the letter, someone had an off day or just couldn't be bothered, I have sent off the MR.

    You must send off your MR request by a written request as by phone you have no proof that the MR is aceppted.  When preparing your MR give several examples of what happens each time you tried and did the descriptors you are contesting with as must evidence as you can supply to support your claims.

    OK sounds like you're doing a good job. Yes they should accept the phone call but only as the date you requested the MR. The adviser probably meant you had to write so they had your argument for an MR to be done. Just to say when I had my assessment making a complaint to the assessment company helped with my MR as then DWP were aware that I wasn't happy with the report or the way my assessment was carried out. It might be useful to try and talk to a case manager if the MR doesn't change anything. Good Luck..
