Pip and Judges decision

Hi, I went to court over my PIP claim 5 years ago and was awarded it, the judge said until 21.09.2019. I find myself in the same position as others having to re-apply, this was started 8 months before the revision date. They decided to not award me again in April, so I have to go the the reconsideration and maybe court process again. But by law can they stop paying before the judges finish date? I appreciate after this date the above could happen? But this way I have lost 6-8 months of awarded payments.... and hopefully I will win again shortly but, as you know with a life changing condition, things will not get any better. Thanks for your advice.

Hi all, i was awarded pip 5 years ago by the judge in court, he stated until 21.09.2019 but 6-8 months ago the DWP stopped payments after saying i was not eligible via Captia , so i am now in the process of mandatory consideration and then probably court again. but my question is, can they stop paying before the judges date is up? I know they start these 6 months before, but that means you do not get your full award. As many of you are aware life changing conditions never improve. thanks for your help.

HI,Even though those awarded by a Tribunal are not usually contacted until 14 weeks before the end date of the award they can re-assess you at anytime. Did you ring to request a change of circumstances?They would also have needed to give good reason why they think you no longer qualify. Your next step is MR followed by Tribunal.Do be aware that Tribunal waiting times are huge in most areas and some are waiting as long as 1 year for a hearing date.Good luck.I would appreciate it if members wouldn't tag me please. Thanks for your reply, there was no change of circumstances. and as I said my end date was September and they stopped payment in April [it might have even been before that] I went to see Captia person and the report must have made me out to be Olympian material!. They said 2 weeks ago that the 10 weeks to reply has only just started as it has taken them 16 weeks to acknowledge request for MC.But with them just withdrawing payments means rent bounces,added anxiety and depression goes 10 fold.I do not think they fully understand the impact of their decisions, especially if you have professional backing/support.
