Hi all looking for some advice my son is 16 he has autism/adhd he was on dla middle care low mobility.we had to change over to pip he has been awarded nothing now even though I told the accessor he struggles everyday with everyday living off personal care he Wong go out himself and he is in an autism unit at school with transport provided anyone got any advice

Hi unfortunately this is very common did you ask for a MR. You need to show how he fits the descriptors to get the points. If he can't go out alone then definitely should have points for that.

Hi,

DLA and PIP are completely different benefits, with different criteria. PIP is about how your conditions affect your ability to carry out daily activity based on the PIP descriptors. It's not about a diagnosis.

As he's been refused you now have 1 month from the date of the decision to request the Mandatory reconsideration (MR) you should put this in writing stating where you think he should have scored those points and your reasons why. Adding a couple of real life examples of what happened the last time he attempted that activity for each descriptor that applies to him.

Any relevant evidence you have should be sent with the letter to support his claim because they very rarely contact anyone for any evidence.

Do also be aware that because he was refused PIP, his DLA will end which could affect any other benefits you are claiming for him, such as child tax credits and carers allowance.

Yes I have 3 young adults also with autism and other special needs. As, @poppy123456 said they are very different criteria you need to understand that it's how fit the descriptiors.

You need to request the MR before you can request the Tribunal. Only 18% of MR decisions change, so you'll very likely have to take it to Tribunal. Waiting lists for Tribunal hearings are huge across most of the country and lots of people are waiting a year for a hearing date, from the time they accept the appeal.

Add that onto the wait for the MR decision and it's in excess of a year.

Having some understanding of the PIP descriptors and what they mean will help so i'd advise you to have a read of these.
