Do i have to de-register as self employed? UC and LCWRA

Hi all, 

I am registered self employed, though claiming UC and due to health conditions was placed in the LCWRA group earlier this year.    

I didn't think to de-register with HMRC, as it was the last thing on my mind, and now wonder if I should have? I feel really anxious and the worry is starting to overwhelm me.   I don't know when i will be able to return to work, but hope to do so at some point in the future.

UC have had me down as self employed since my claim first begun, and continue to send me an online declaration of earnings form to complete each month online which, I complete and submit with 0 earnings.  

I don't know if it is ok to keep things as is or if I should just de-register as I'm not earning or fit to work at present.  I note on the hmrc website that the de-register form asks for date when stopping self employment.  I don't know what to do.

I am also wondering if I de-register, does this affect my UC and call for a reassessment?  I dread the thought of any kind of assessment!

Any advice would be much appreciated.

    If you're no longer working then it would make sense to de-register. As you were self employed do you have any paperwork that may give you some idea as to when you last worked?
    Doing this will not affect your UC because you've already been found to have LCWRA. As far as i'm aware reviews for the work capability assessment are still suspended, i've not seen anything offical saying otherwise. Even if they have started back up, if you're referred for another work capability assessment then it would just be a coincidence.

    Hi Poppy, I feel so stupid asking this, but do I need to let UC know once I de-register with HMRC? or does this happen automatically? I'm thinking it will be seen as a change of circumstance? even though I haven't been working, so not making any money, which UC are aware of.  Should I let UC know via my journal? I don't know what I should be doing, it's making me feel so anxious. I hope this does not now confuse matters.

    You should let them know, this way you won't receive anything for the earnings and expenses each month. It won't affect your claim because you've already been found to have LCWRA.

    UC should have you down as on LCWRA and also not working and stop asking for monthly income.

    UC should have you down as on LCWRA and also not working and stop asking for monthly income.
    That is not correct. Having LCWRA doesn’t necessarily mean someone isn’t working. If registered as in self employment it will be necessary to make monthly reports - even if the figures are nil.

    OK, that means they need to de-register from self employment?

    I'm on LCW and still registered as self employed, i submit yearly accounts, UC have me as not working and I don't have to submit monthly income. So I was saying from my experience.

    I suspect the experience will vary depending on the work coach or case manager. 

    I agree that if UC have claimant down as no longer gainfully employed than monthly reports will not be required. I read you previous post to mean that you were saying that LCWRA automatically meant that OP would not be working and therefore treated as such. Reading you recent post I realise that may not be what you intended.
