Intervention - By Midday Meal Supervisor???

Today my son was taken outside on the climbing frame to do gross motor skills by a Midday Meal Supervisor. During this time a considerably younger class has come out for lunch, it was their time to be on the climbing frame and 5 boys pulled my son off wrestled him to the floor, 3 were on his back 2 held his arms.. during his struggle my Son fell & hurt his thumb he told the midday lady he hurt his thumb, she told him to get first aid. 
Upon hearing this I went straight back to school made them aware and they are taking my Son to identify them tomorrow.
Now I'm questioning can a Midday Meal Supervisor take a child for intervention? She's had no training in SEN and clearly was observing the other children rather than concentrating on my Son. 

I attended Mediation on Monday and the outcome was that they will be recommending to panel to assess for EHCP in light of the school failing to provide reasonable adjustments.

    My son was bullied throughout his school life its horrendous. Is your son suffering from Dyspraxia? Is he on the Autism Spectrum. I would not have assumed an untrained member of staff should be doing training .

    Why did they not have a EPCH before this. That's a get out clause. They have a legal duty to refer your child. You are entitled to an assesment of his needs.

    Dont accept a poor reply for their failings.

    If you look at my previous posts I have put quite a bit information and links on about Autism Spectrum, Dyslexia , Dyspraxia Dyscalculia, Irlen Syndrome and PDA.
    Your son should have had a EPHC , that's an absolute disgrace on behalf of the school. .  

    It takes a bit to plod through but I am sure it will help. The school also have a duty of care to your son.

    Make sure you keep a record of what has happened , who you spoke to , the outcome .

     I have just used my house insurance legal aid to sue a LA over an accident at school which should never have happened.

    My boys were late diagnosis and it's ongoing. Absolute nightmare . Poor wee soul his anxiety is at a high , being blatantly bullied will really have a massive effect on him.

    The other reason why he needs to be protected against the bullying is the social issues he has, he won't understand how to deal with the bullying.

    Schools have these Stratagies and policies against bullying but as Danny Moore and I have encountered they are not worth the paper they are written on.

    Recently been refused assessment for EHCP - had Mediation a week ago.. I quoted about SEN policy and equality act 2010 that the school had failed to make reasonable adjustments - hence the change in decision to assess. 
    Everything is being documented by myself regarding failure to support/incidents which occur.
    my son will be attending an assertiveness course for anti bullying.

    Make sure you get a full assesment of his needs. Don't take any notice of " We have 20 years experience brigade."

    Did you know that bullies are often Autistic. It's the lack of social understanding. Worth mentioning to the school.

    One of mine was not even referred . 

    Its shocking this information is not available up front . Steep learning curve.

    If it gets complicated and you can't afford a Lawyer these are a sort of Charity Lawyers who will act on your behalf and give advice. They act on behalf of Education issues . The would suggest the normal complaints procedure first then progress from there.
    It sounds as though you have had a rough deal so far.

    Look for groups like this for all abilities . I know the College where my son attends has special music groups for children and young people on the Spectrum.
