Asking for your experience with appealing DWP decision after Health Assesement

Hi, I have tried to go through forum, but found quite old posts only, so thought I will ask.I have just sent appeal to Tribunal after DWP decison about not awarding me LCWRA. I just want to ask about people's experience, how long you had to waitto go for court hearing, is someone from DWP there? I will be at the hearing. And obviously, how was the hearing? Just curious in general about your experience, thank you.

    I've not dealt with a LCWRA tribunal, but I have had PIP tribunals and they'll be roughly the same.ย  It's rare for someone from the DWP to turn up, as there's so many tribunals happening now. But the tribunal itself was pretty relaxed and the people were very supportive and lovely. It was a world apart from the original assessments!
    ย Wait times can vary depending on where you are in the country, but I've heard of waits of up to 10 months previously, I'm unsure what your wait time would be unfortunately.ย

I am surprised about 10 months wait, but obviously you never know:-) I agreed to telephone or video appointment with Tribunal, so I am hoping it could be sooner than later. I am patient and can wait, as I am not hoping for much. Thank you again for your reply:-)

    Hello, just came across this post .ย 
    I had my appeal this week after waiting around 6 months for the appointment. My appointment was 4pm so I was lucky it wasn't to much of a wait, I actually went in early and was back out around 15mins later whilst they made their decision (that may not be the case for everyone).ย 

    I was absolutely dreading my appointment and did struggle through it but they were lovely and really accommodating. I could take a break if needed I just needed to let them know.ย 
    I had a judge and a doctor in mine, no DWP in mine. I was only asked a few questions but I guess that will vary with people. The judge did want to ask a few more questions but could tell I was upset and distressed so both agreed they had enough information to finish.ย 

    Overall, besides the wait, it was a hard but positive experience.ย 

    Fingers crossed you don't have much of a long wait ๐Ÿ˜Š

    glad you finally have your date.

    I did the same thing. Wrote somethings down to remind me incase my mind went blank. They will already have in mind what questions they want to ask, which makes it alot easier to deal with. Less panic.

    Remember they are not there to try and trip you up, they are independent to DWP. They just want to hear you in your own words ๐Ÿ˜Š

    I've waited 15 months for my appeal and it was due last Wednesday and it was cancelled less than 24 hrs to go with no indication of a future date.

    Iโ€™m sorry to hear that. Unfortunately these things do happen. Did they give a reason why it was cancelled?
    Hopefully you wonโ€™t be waiting too much longer for a new date.

    I had my hearing today,there was a guy from DWP, and I thought, "great, we will be arguing then", and then judge said "I believe there was a development from DWP", and I thought, what development, all documents were sent, there was nothing new, and then DWP guy said they have accepted my appeal! From 0 points to 15!!!!!! I am quite calm person, but was crying like an idiot:-)Couldn't really believe it, I didn't have much hope before hearing:-)

    So yes, good news, it shows it is worth to fight until the end:-)

    Amazing news!! I'm so glad it went for you. DWP really do annoy me with what they try to get away with. Such ashame as it puts so much unnecessary stress on claimant's and even the tribunals.

    Oh don't worry about the crying, I was the same all the way through ๐Ÿคฆโ€โ™€๏ธ.

    You can finally put it behind (it will take a minute) and move forward.

    Thank you, I still cannot believe they have accepted my appeal before hearing has started:-) Just wondering what was the reason, but obviously does not matter much:-)

    They said the judge assigned to the hearing was now not available. When I called to ask if they had a ball park figure of how long the wait would now be, they said they had no idea and I would be notified when the new date was made. I would assume (probably wrongly) that it would now take priority with available dates seeing as it was cancelled by the courts service not me.

    It will be a different panel next time. I don't think you will take priority but you will be notified once a date becomes available.
