What exactly do points 3 and 4 mean? Am I going to be potentially losing my UC element?

    No, you won't lose your LCWRA award. Point 3, Secretary Of State means DWP and they now need to put the award into payment. The decision has already been made by the Tribunal and the only way to change this is for DWP to appeal that decision. This can only be done on error of law and to find that they first need to request the statement of reasons and record of proceedings.

    Point 4 means that none of the descriptors applied to you for LCWRA so they looked at substantial risk which did apply. For LCWRA what they do first is look at the descriptors to see if any of them apply, if not they then look at substantial risk which did apply.

    I forgot to ask also, how long should I be expected to wait for back payment to be paid to me? I've dropped a message in my journal asking about it but haven't heard anything back as of yet

    It can take up to 8 weeks after a Tribunal win to put the award into payment and pay what is owed.
