i have today received my MR from my PiP application back in November 23. As expected the MR has not deviated from the decision letter which I received. My next course of action is to commence the tribunal process and I have already started this online. How much detail should I go into on the form which asks why I disagree with the decision? Shall I simply cut and paste the letter which I prepared for the MR which discusses each point of the decision letter and why i disagree and what i think i should be awarded in regards to points? Advice at this stage would be much appreciated

Hello @Lanson66 I'm sorry your MR has not been successful although kind of expected unfortunately. It's a lot of stress. Can I ask if you requested a copy of the Assessment Report written by the person doing your assessment that would then have been sent on to a Decision Maker at DWP? I see you refer to the Decision letter from DWP but the explanations they give can vary dramatically from the actual Assessment Report written and sent to them. Excuse me if you've already done this, but if not, I would kindly suggest you request a copy of it. I personally argued each point from the Assessment Report which was vague and contradictory at best, and not the explanations given in the Deacon letter. A copy of the Assessment Report would hopefully help with a tribunal going forward.

The assessment report isn't needed at this stage. You will receive a copy of that and everything else you sent to support your claim in the bundle once it's sent out.

I wouldn't advise anyone to concentrate wholly on the assessment report. The Tribunal already know that a lot of assessment reports are flawed, they don't need to be reminded of that. It's fine to point out a couple of obvious errors but then put it to one side and forget about it.

For the Tribunal request you just need to give a brief reason why you disagree. If you have anything extra to send, including your submission you can do that at a later date.

thank you both for your advice, obviously I didn’t want to send too much or of course too little.

i have sent my online tribunal appeal and have received 2 text messages. The first acknowledgment of my appeal and the second was to provide a reference number and confirmation that DWP have 28 days to respond to my appeal request. I guess that is at least positive and although I know I am in for a long wait, the process has begun.

Good luck and I hope it doesn't drag out much more! November 2023 is ridiculous!
