SAR request rejected
I made a SAR request on a hospital that treated me 32 years ago and it was rejected on grounds of time (they claim that my medical records were destroyed in the meantime)
This is wrong - records are supposed to be held until 10 years after the patients death - and I am still alive !!

Where did you read 10 years after a patient's death? I believe the British Medical Association says 8 years after last treatment OR 8 years after a patients death.

Hi @Wibbles. I found some information here.
"Different records are kept for different lengths of time. Most records are destroyed after a certain period of time. Generally most health and care records are kept for eight years after your last treatment. GP records are kept for much longer."
There's more detailed information here about different types of records and the length of time they are kept. Hospital records are not kept for as long as GP records which is why they may have rejected your SAR.

Hi @Wibbles, it says "20 years, or 10 years after death" so I'm assuming they were destroyed around 12 years ago. Sorry that's probably not the answer you were looking for.

It says 20 years or 10 years after death. You said it has been 32 years which is longer than 20, which is why they have been destroyed.

I took that to mean whichever is the “longest” rather than the “shortest” ?

I made a SAR request on myself at another hospital - 4 weeks ago and received an update yesterday - they want another 12-14 weeks to gather the information !!
They are supposed to be able to get the info to me within 4 weeks
What should I do ? Complain to the ombudsman ?

I'd say it's still in PALS territory @Wibbles it's best to try and work with the hospital before going elsewhere.
