Mandatory Reconsideration Success
Appeal or Not?
My mandatory reconsideration was successful. I was one point away from receiving the highest amount of daily living (got awarded highest amount for mobility which was zero previously).
Is it worth appealing?

Hi @HealthyUnicorn. You can appeal the decision but be aware that the award could stay the same, increase, or you could lose it. There's no way of knowing how their decision could change, if at all. It depends on whether you want to risk it.

If there's any chance of losing your current award you will be warned before they remove any points. They would either send a letter before the hearing to warn you there's a risk points could be removed. If you decide to go ahead you do so at your own risk. Or you can cancel the hearing and continue with your existing award.
Or they will warn you on the day of the hearing. It will then be adjourned so you could go away and consider your options. You can then either continue or cancel the hearing.
If you do proceed I'd advise you to either appear in person or request a telephone/video hearing, either of those will give you the best chance of a decision in your favour, around 70%.
Paper based hearings have a considerable less chance of a decision in your favour.

do they always warn you that you might lose points or your award before an appeal or at the hearing stage?

Yes they should always warn you.

Ah. So they might not.
I think I’d best leave it as another £1600 annually doesn’t seem worth it.
