    First time on and i will try and make sense of my post…lol

    Am based in Scotland and on DLA top rate for both elements and looking a getting carer in, but am confused in a couple points.

    1. Does the carer allowance come out of my DLA or UC payments?
    2. The person that receives the carers allowance do they lose money as UC deduct it from there payments ?

    It's all very confusing navigating around UC I've just found out that a private pension payment is classed as unearned income and you pay a £1for £1 back to UC. I assumed when filling out my UC claim it was an income so was treated as less than £400 a month income. I now owe them a few ££££ plus the deduction of my private pension from my UC payment

    If the person that wants to claim carers allowance is claiming UC then the carers allowance will be deducted in full from any UC entitlement. For this reason there's no financial gain to claim CA at the same time as UC.

    They can claim carers element of UC providing they are not claiming the LCWRA element for their self. If they are then the same person can't receive both elements at the same time.

    Yes, that's correct a pension is treated as unearned income and is deducted in full from any UC entitlement. If you were claiming your pension when you claimed UC then one of the questions asked when filling in the form is do you receive any pensions.

    Do i pay The carers allowance?

    I checked my original UC Claim i didn't receive my Pension at that time and obviously never updated it:(

    I'll need to update it and pay back the overpayment and also get the pension payment deducted for my monthly payment.

    CA is a completely different benefit to carers element of UC. Therefore no, they will not receive CA as an extra payment. Are they currently claiming UC?

    They need to claim carers allowance separately but it's deducted in full from their UC. There's an earnings limit of £151/week when claiming carers allowance so they need to be aware of that.

    The CA is not deducted from your UC or your DLA. DWP are responsible for administering carers allowance. https://www.gov.uk/carers-allowance/eligibility

    ok so there best to claim the carer element via UC.

    There not work now so no earnings

    Are they already claiming UC? If so does it include the LCWRA element?

    I see you live in Scotland. In some areas in Scotland carers allowance has changed to carers support payment. Same rules apply to this as they do for carers allowance. You can check here if it's this they need to claim.

    If they claim that or carers allowance they will be entitled to the carers allowance supplement twice a year. For this reason they should claim either of those, which ever one applies to them.

    It is never the best idea to ring either DWP or SSS to ask for benefits advice because they are not benefits advisors.

    If you want expert advice it's advised to speak to an advice agency near to you.

    @vikki66 I didn’t realise that because I don’t live in Scotland, so thank you for that.

    It is good to know that they will give benefits advice too. I only wish DWP did the same thing.
