    If you're still not getting any joy with the money you're owed maybe it's time to contact your local MP. They will hopefully contact UC on your behalf and get them shifted.

    Hi just got a msg on my journal saying I've not reported a change of circumstances it's basically saying when I signed on in 2021 I had £15.500 in my bank and I never knew that it mattered how much I had

    Capital of more than £6,000 affects the amount of UC you're entitled to. There's a £4.35/month deduction for every £250 or part thereof over £6,000.

    Capital of more than £16,000 means no entitlement to UC.

    When you first claimed UC there would have been a question asking you if you have any capital.. savings, properties etc etc.

    Did you have that much capital when you first claimed UC?

    Yes poppy but I'd just come out out work and to me what was in my bank was wages not savings and at the time I didn't no how much I could have why didn't they ask me to bring a bank statement on my first appointment so how much a month will they take as I'm on lcwra aswell xx

    If you didn't report that capital, how could they ask you to provide bank statements? They would only ask you to do that if you reported the capital.

    Capital is anything you own that's yours, including lump sums like that. The deduction is £17.40/month for £1,000 over £6,000. How much you owe them will depend on how much capital you had and for how long. If your capital decreased each month then the deduction would decrease.

    It seems like they are holding onto the money that's owed to you while they recalculate your statements to work out how much you owe them. They can take back what you owed them from what they owe you.

    Did your capital ever go above £16,000? The money you receive from UC and any other income is not treated as capital until the end of the following assessment period after you received it.

    No poppy it was 15.554 and it's all gone it's even on the bank statements I sent in why don't they ask people to bring a bank statement in on the very first time you go to UC ? I told them on my journal I knew nothing about saying what was in my bank so isn't this DWP error?????? Xx

    It's not a DWP error unfortunately, you'd have been asked about capital when applying for UC, you thinking your wages didn't count as capital is down to you and not them.

    Wages in my bank it's not saving as I spent more a month out of my bank than I got paid UC per Month and it's all gone it's all on four years of bank statements I sent in they should ask new claims to bring bank statements in on the first UC appointment end of because when they asked if I had savings I said no because I've never seen what's in my bank as savings because I use it daily I'll take them to court I'm sick of the [Swearing removed by moderator] picking on people who have worked all their lives paid hundreds and hundreds of thousands of pounds in tax and NI

    I'm afraid your thoughts here are not correct. Anything you have in your bank, at home, in a savings account is savings (capital) when you claimed UC it asked you if you have savings and how much you have.

    This isn't DWP's fault or their error. Please be mindful of your language, it's really not nice to speak that way.

    We are here advising you of the rules when claiming means tested benefits. Paying tax and NI all your life doesn't automatically entitle you to UC.

    Hi @luke47 I understand it's a tense time and frustrations are high, but please remember swearing is not allowed on the community.

    And unfortunately, Poppy and Kimmy are correct, any money in a bank account (unless stated by the DWP as exempt) will be classed as savings.

    I will apologise all it gets is stress off UC .and yes the money in my bank went because I was spending over 1k a month so now I have no savings or any capital

    You will have an overpayment but how much that will be will depend on how long you had capital of more than £6,000. You will need to repay back what is owed and there will be a small fine on top for not reporting the capital. I'm afraid I have no idea how long it will take them to make a decision on that.

    They may also question what you spent that money on, if it reduced below £6,000 quickly. If you used it to pay off debt that that will be fine.

    Hi poppy yes the money went down quick because I was using it to live off as 323 pound a month was not enough they have got all my bank statements so will be able to see that I used it every day like I told them on my journal I'm just stressed especially with Xmas around the corner.
