Hi, please could someone give me some advice please. I was let go from my job as a carer in November due to my lack of mobility I have a fixed flexion deformity resulting from a failed tkr some years ago. I had a work assessment for uc and esa on the 4th April. Today I received a message from the assessor saying that they had received my wca and needed to speak to me, when he did he went through the assessment from the 4th April then said I had not got the 15 points needed for Lcw. I’m completely housebound and find it difficult to get about without assistance, and my leg does not fully extend and I walk on tip toe and limp badly. This affects my lower back and right leg and makes me tired and breathless. Also I may also have angina which I have explained and that I’m going for tests on the 15th may and in the meantime have been give a spray to help with any attacks. Can anyone advise me where I stand ? Thanks. Also esa has been stopped and I have been transferred to uc.

It will have been the decision maker you spoke to today and not the assessor. The assessor doesn't make decisions, a decision maker from DWP does.

You can request the Mandatory Reconsideration (MR) for this decision. If the decision was for UC then you can request this on your journal, assuming you have access to one. You need to state whether you think you should be awarded either LCW or LCWRA and your reasons why. You can see the descriptors for both groups here.

Once the decision is made on the MR if you're not happy you can proceed to Tribunal.

Hello @karen57 I'm so sorry the assessment didn't go in your favour and I'm sorry to hear you've been housebound with your health. Can I ask, do you have support around you? We are always here if you want to chat or vent. Our Coffee Lounge is where we have most discussions, debates and play games.

Keeping everything crossed for your Mandatory Reconsideration 🤞

    Hi Hannah
yes I have support with family and friends. I have asked for a mandatory consideration on my journal which has been noted but I won’t hold my breath. The DWP aren’t the best are they?
    Thanks best wishes

The most likely outcome of any MR will be the decision remains the same. You can request the Tribunal once you have the MR decision.
If you either appear in person or have a telephone/video hearing then this will give you the best chance of a decision in your favour.

Thanks I don’t hold out much hope of them changing the decision
but at least you have to try them move forward. Thanks

Hi, could anyone tell me if my Gp could help with the MR or has any input? Thanks
    karen.

Letters from a GP aren’t the best evidence to send because they will unlikely know anything about how your conditions affect you exactly. They will only know the basics such as diagnosis, medication etc.

    Hi,

I see this has been solved in another thread.

Just wanted to say that if your payment date is on a Sunday, it should be paid on the Friday before the weekend instead.
