PIP award no mention of back pay to claim date.

Hi
I applied for PIP on my daughters behalf in Feb/March (sorry can’t remember the exact month) and today we have received a letter stating they have awarded her enhanced rate for both components. It tells us how much a week it is but they haven’t included or mentioned the back pay to the date of claim. It only says money owed £123 for between 27-31st July 2023 and then every 4 weeks after that. Would there be another letter that will give these amounts or is there a reason why they wouldn’t have paid from the claim date?

It doesn't sound like she transferred from DLA becuase of the £123 they say they owe you. When applying for PIP you must have had the difficulties for at least 3 months, if she didn't then this is why they haven't awarded from the date you rang to start her claim.

Hi she wasn’t on DLA previously. It was a new claim as she has had anorexia nervosa for 3 years but more serious since the end of last year with a hospital stay for 2 weeks in April. So it should have been backdated. I did put on the form when the eating disc order started which was 2 years before actually making a claim.

Then you will need to contact PIP. If they tell you that the 3 month waiting period applies then you can request the Mandatory Reconsideration on the decision not to start the claim from the date you rang to start it.

Thanks I’ll give them a call on Monday as I can’t see why they wouldn’t have backdated to the initial claim date. Looks like they are only doing it from the date they made the decision which I’ve never heard of them doing especially if the illness has been going on longer than the claim date.

It’s not often that this happens. It’s usually reviews that are from the date the decision was made.

New claims are usually from the date you rang to start your claim, providing you had the difficulties for 3 months.

hi could I ask your outcome on this? My partner has had this today? Been awarded but no back pay looks like paid from when decision was made? I’ve never known this to happen! Crazy as my partners conditions have been way longer than 3years plus and this was stated

hi, I rang them up and they had made a mistake and given the wrong date to backdate to. They sorted it quickly and my daughter had the other money in her bank within a few days. I would give them a call and see.

I did call them and they said something about qualify period of illness I didn’t understand to be honest like how can they award if he’s illness wasn’t there if that makes sense? And to do a reconsideration do you think I should or give them a call back again and ask for explanation more? It seems crazy how they can award but then say period hasn’t started x

Did they transfer from DLA? If so then there's never any money owed in this case. If they didn't then they will need to contact PIP if they've had the difficulties for at least 3 months.

Hi @poppy123456 no this was a new claim never claimed before he’s had these problems for years alongside more problems and this was stated in the pack we done and in his assessment he was awarded high rate care and low rate motabioty but they said he doesn’t get any backdate something about qualifying period? But he’s problems have been years which is why he’s been awarded I just don’t get it should I maybe call and ask to speak to someone different or? What’s your views please x

The qualifying period refers to the backward 3 months test I mentioned above. He can request the Mandatory Reconsideration on the decision not to award from the date he rang to start his claim. He should put this in writing.

thank you I did call and they did put in for a mandatory reconsideration as the man on phone (case manager) had said from looking through the paperwork and all the comments etc he wouldn’t of done the award like this and he would of been awarded backpay…I’ve never known this to happen considering if they say he’s not been well for at least 3 months then how has he been awarded..it’s stated in questionnaire and our assessment that these problems have been ongoing years…what are the chances of this been turned around do you know? I’ve never heard of this to be honest

An award can still be given because a claimant could still be having difficulties but if they haven't had them for at least 3 months the award will not start until those 3 months have ended.

I forgot to mention that he also needs to have lived in the UK for 2 out of the last 3 years. If he hasn't then this could be the reason why it wasn't paid from the date he rang.
