@h69 i found some information on Rightsnet about UC refusing to look at the decision again, saying it can’t be changed because its law. Please have a read of this. It also advises what to do is this case. https://www.rightsnet.org.uk/forums/viewthread/20466/#96207

Hi no I have just had my first deduction of £198 loss of my TE and now I don't know what to write in my journal about appealing this "to stay behind the upper tribunal" i have been unable to find out if the case has even been heard in October and any results but as you stated its unfair I was told to submit Fit notes on day of migration and as you say we are worse off for this it isn't right at all. Where do they expect people to find the short fall of such money to pay stuff. I am going to try journal this when I get onto my laptop in my UC journal and see what they say CAB have advised appealing they were the ones who made me aware of this tribunal it's a complete nightmare the whole lot I didn't choose to be chronically ill and now I'm feeling forced to try looking for work round my health cause losing so much money its horrific 💔

@h69 there’s no information at all about that hearing so I can only assume that a decision hasn’t yet been made.
It’s likely a very long process and even if a decision did go in the claimants favour any money owed will take time for it to be paid. This is usually the case with upper Tribunal cases.

@Poppyangel2004 i absolutely agree. I’ve written in my journal that I first want to request a Mandatory reconsideration on the grounds of discrimination ie referring to my above example regards how someone awarded LCW wouldn’t be penalised. That’s going back and forth at moment to even get them to allow me to do that - however I’m going to read the link that poppy12345 has posted regards what to do in this situation if MR refused (which will be a possibility for you too).
I will cite the same reason when I appeal too.

You’re welcome. I don’t think that you should use the LCW as an example though because those that have claimed this since April 2017 wouldn’t be entitled to any extra money anyway so would still be entitled to the carers element.
