Hi much to my shock I’ve been awarded LWRCA was expecting to have to fight for it after seeing posts about the horror of the whole process . Im not used to things going smoothly for us but it did . I just told it how it is the truth such a relief to be taken seriously . Do I have to notify anyone ? Council tax people things like that ? I have not a clue still with the whole UC process . Moved on to uc in sept 24 with a fit note dated before we applied .

    It would be a good idea to notify Council Tax.

    LCWRA has a waiting period of three full assessment periods, from the date the first Fit Note was handed in. No money is paid or subsequently owed for that period.

    September/October: AP 1

    October/November: AP2

    November/December: AP 3

    December/January: Eligible for LCWRA element.

    30th January: First LCWRA element paid*

    If they don't have enough time to process the decision before your next statement, they will owe you 1 month LCWRA element.

    Money owed will be sent as a separate payment. You'll receive a Journal letter when this has been done confirming the amount. It will then be sent a few days later.

    *If you have Transitional Protection on the claim, it will reduce by the LCWRA amount.

    *If you have Carers Element in your name on the claim, LCWRA will replace this as the same person cannot get both.

    *If you have a partner on your claim who gets LCWRA, no money will be paid as within a couple the maximum number of LCWRA elements is 1.

    Yes, you should report the changes to your local Authority. Whether this changes any council tax you need to pay will depend on the rules with your LA because all of them are different.

    If your UC includes any Transitional Protection (TP) then this will also erode with the additional LCWRA element when it's included. If your TP is more than £416.19/month you will not be any better off financially.

    If 24th Sept was the date you submitted your claim, with a fit note then your waiting period for LCWRA will be Sept/IOct, Oct/Nov, Nov/Dec.. LCWRA starts from assessment period 24th Dec to 23rd Jan and first payment will be 30th Jan. No LCWRA element is owed. This is assuming there were no gaps in your fit notes.

    Just so that you're aware, the majority of people are usually found to have LCWRA. Usually it's PIP that's the most difficult to claim.

    (unless you're partner already receives the LCWRA element then you will not be entitled to any extra money)

    No TP doesn't last forever, it erodes when other elements increase or you become entitled to other elements.

    As your partner also works if you didn't previously have the work allowance then you'll now be entitled to that. This will apply from the start of your claim. It means that some earnings received will be ignored before deductions apply.

    If you claim for help with the rent it will be £404/month, if you don't then it will be £673/month. For every £1 of earnings received over those amounts your UC will reduce by 55p.

    Thank you and you're welcome. Just to include more information, you mentioned your partner wasn't claiming carers element because they work. If you're claiming a disability benefit such as PIP daily living then you partner can claim carers element for looking after you. There's no earnings limit to this like there is with carers allowance.

    The only downside is that this would also erode any TP you have left after the LCWRA element is included.
