Hi everyone, so happy to have found you all, I'm finding everything really confusing at the minute. Been awarded lcwra and worse off, had a message on my journal saying the technical team is looking into it

I was claiming carers for my son who has autism. I understand you cannot claim carers aswell as lcwra (which baffles me as I can still look after him). When I was claiming income support before changing over to UC I was getting the severely disability with income support (£65.85). I'm sure I've read somewhere that if you claim that they cannot take the lcwra off the transitional protection, is that right.

It's correct that LCWRA reduced your Transitional Protection, there are no exemptions.
Did you claim Carers Allowance or Carers Element for your son?
With pre existing entitlement to Carers Element unfortunately what happens when awarded LCWRA, the CE is removed and the Transitional Protection reduces due to the LCWRA, leaving people worse off.
There was an Upper Tribunal court hearing on the matter a few months ago, the outcome of which is not yet known.

Okay, I'm not sure what has happened with your claim then.
LCWRA erodes TP but shouldn't make you worse off, just no better off in some circumstances.
Carers Allowance will continue to be deducted in full from your UC award.

I was thinking the same. Something has gone wrong somewhere. Lcwra has been deducted from TP and also wiped out carers

Are you absolutely sure you get Carers Allowance, not and/or Carers Element?
Have a look at one of your statements prior to the LCWRA award, see if Carers Element of £198.31 is on there.

That sounds like your UC included carers element as well as Transitional Protection.
Kimmy is correct with her advice and the carers element will be removed and your TP will reduce.
How much was your Transitional Protection before you were awarded LCWRA?

I've looked at letters when I was on income support and it says carers allowance

TP before lcwra was £536.32
With lcwra is now £120.13

Carers allowance is a separate benefit and yes I would expect you to be claiming that. This would have continued when you migrated to UC.
When you claim UC you should have also been claiming carers element, which is part of UC.
Your carers allowance would have been deducted in full from any UC entitlement.
You can check your first couple of months statements for UC and it should show carers element at £198.31/month. When the LCWRA element was added the carers element would have been removed.

You are misunderstanding what we are advising. Carers allowance will continue and won’t be removed now the LCWRA element is included. It will continue to be deducted in full and you will continue to receive carers allowance separately as normal. This is because it’s a separate benefit.
It’s the carers element that would be removed.

Yes on the screenshot above I can see carer, which is £198.31, this is carers element. As you’ve now been awarded LCWRA this element will be removed.
Your Transitional Protection was £536.32 but the LCWRA element of £416.19 will be deducted from that. Therefore your TP will reduce to £120.13.
You will unfortunately be worse off by £198.31 which is the carers element.
I don’t see a deduction for carers allowance showing on the screenshot but that’s likely because it’s further down the statement.

Yes then unfortunately it's as I suspected.
The advice in my second post is correct.
The award of LCWRA has reduced the Transitional Protection and removed the Carer Element, as the same person cannot get both.
As things stand it is correct.
The financial aspect has been challenged in the Upper Tribunal hearing, the outcome of which isn't yet known.

It really is terrible how so many people have been affected by this. I wish the work coaches would give a warning of some kind before the claimant provides a fit note. I know they are not benefits advisors but still…
Even more so because when you’re a carer you have no work commitments anyway. Frustrating and I hope the Upper Tribunal rule in the favour of the claimants.
