Awarded LCWRA, will I be back dated and when can I expect payment?

Hi, I have been unfit for work for a number of months and have been awarded LCWRA on the 2nd of December, my first fit note was on the 10th of July, will I be back dated and when can I expect my payment?

    Hello @Adam_125. Do you know what your UC assessment periods are, or what date you usually receive your UC payment?

    I'm asking because there is a 3 full assessment period (AP) wait before LCWRA is put into payment, with you receiving LCWRA after the fourth AP. Without knowing the specific dates of your claim we would be unable to answer your question.

    My usual payment date it the 16th of every month.

    I'm better at these calculations with assessment period dates, this is my best guess.

    LCWRA has a waiting period of three full assessment periods, from the date the first Fit Note was handed in.

    July/August: Partial AP, excluded from waiting period.

    August/September: AP 1

    September/October: AP2

    October/November: AP3

    November/December: Eligible for LCWRA element.

    16th December: First LCWRA element paid*

    If there hasn't been enough time for UC to add the LCWRA element to your December statement, they will owe you one month*

    *If you have Transitional Protection on the claim, it will reduce by the LCWRA amount.

    *If you have Carers Element in your name on the claim, LCWRA will replace this as the same person cannot get both.

    *If you have a partner on your claim who gets LCWRA, no money will be paid as within a couple the maximum number of LCWRA elements is 1.

    @Kimmy87 an assessment period lasts for one calendar month. Payment dates are usually 7 days after the assessment period ends, or 6 days after it starts. So for example, in this case the payment date is 16th of the month so their assessment periods are 10th to 9th of every month. To make it a little easier for you to work out, what I usually do is minus 6 from the payment date and that's the start of the AP. I hope this helps a little.

    For this reason their waiting period (assuming there were no gaps in the fit notes) will be July to Oct.. LCWRA starts from 10th Oct to 9th Nov and first payment will be 16th November.

    Any money owed will be paid as a separate payment.

    You have been awarded LCWRA from 17 July 2024. The payment element of this award is added to your claim after 3 full assessment periods. This is known as the relevant period, which is:08/07/24 - 09/08/2408/08/24 - 09/09/2408/09/24 - 09/10/24This means that your first assessment period where the monetary award was included would have been 08/10/24 - 09/11/24. In this way, your claim has been backdated, as the award has started from 17 July 2024.

    Yes, the first Assessment Period that you qualified for LCWRA to be in payment was October - November as Poppy advised.

    So using the payment dates:

    November 16th

    December 16th

    January 16th

    They owe you 2 or 3 months LCWRA element, depending on whether it has now been added to your latest statement.

    I received my 1st lcwra payment on the 14th Dec, nothing for Oct- Nov period. So im guessing that will be 1 assessment period backdated?

    Do you know how long it takes to be paid into account, sorry.

    Yes that means they owe you one months LCWRA element.

    You'll know this has been processed and calculated as a letter confirming the amount owed will be added to your Journal. The money will then be paid within several working days.

    It's impossible to answer as to when this will be done.

    Hello again, so I've received this message this afternoon, but doesnt seem right? Just wondering if you could have a look and tell me if it's correct please:

    Unfortunately not, as your LCWRA award was first in payment from the November assessment period of your previous claim. This would be the first full assessment period following the end of the relevant period required before payments of the award begin

    If you were awarded from 17th July, why are they counting 8th July to 7th August as the first month? This doesn’t sound correct to me.

    If it’s from 17th July then your waiting period would be Aug to Nov.. LCWRA starts from 8th Nov to 7th Dec and first payment would be 14th Dec, which you received.

    May I ask please what date exactly you provided your first fit note?

    I'm under the impression, because the 3 months finished on 17th Oct, rather than/before the 8th, before assesment period begun, they won't backdate it as it wasn't a full assessment period?

    That’s correct. It has to be 3 full assessment periods. Then it starts from the 4th month, with first payment being the end of that month due to UC being paid 1 month in arrears.

    When you posted earlier on today that first message you had on your journal was incorrect.
