Advice - LCWRA??

Hi everyone -can somebody help please?

I uploaded my first sick note on 5th July 2024… Still uploading them now with no breaks

My assessment period 8th - 7th.

I sent my UC50 form 30th Sept and had my assessment 6th Jan 2025

I requested a copy of my assessment report last week (14th) and recieved it the end of the week. at the end of the statement it said 'the client was found to meet the criteria for LCWRA'

How long will it be until i recieve a decision roughly?

Also, will i be due any back pay? What months are disregarded and what month will i be paid from?

    Decision times are anything up to 12 weeks.

    LCWRA has a waiting period of three full assessment periods, from the date the first Fit Note was handed in. No money is paid or subsequently owed for that period.

    With your dates:

    June/July: AP 1

    July/August: AP 2

    August/September: AP 3

    September/October: Eligible for LCWRA element.

    13th October: First LCWRA element paid *

    By my calculation 4 months LCWRA element is currently owed.

    *If you have Transitional Protection on the claim, it will reduce by the LCWRA amount.

    *If you have Carers Element in your name on the claim, LCWRA will replace this as the same person cannot get both.

    *If you have a partner on your claim who gets LCWRA, no money will be paid as within a couple the maximum number of LCWRA elements is 1.

    It usually takes several weeks at least for backpay to be calculated.

    You'll know this has been done when a letter is added to your Journal confirming the amount owed. The payment will then arrive several days later.

    Kimmy, your calculation for the waiting period is not quite correct. Health condition and fit note reported on 5th July, not June. The fit note was provided in the middle of AP 8th June to 7th July, which doesn't count. Easy to do with all the dates given.

    Assessment period dates are 8th to 7th of every month. This means that they waiting period would start from 8th July because that's the start of their AP.

    Therefore waiting period would be July/Aug, Aug/Sept, Sept/Oct.. LCWRA starts from 8th Oct to 7th November and first payment would be 14th November.

    OP reported health condition 5th July and Fit Note supplied same day.

    As it was the first Fit Note I thought it fell under the 7 day rule?

    Making June/July count as the first full assessment period.

    No, that’s not correct here because the health condition and fit note were both reported after the June/July assessment period started.

    Your thoughts only apply if a health condition was reported at the start of an AP and a fit note provided within 7 days of that.
