Help with PIP three-month claim rule

Hello to everybody! I'm new to this and wanted to ask a question on behalf of my partner. Basically she had a stroke around the 6th September, she came home in the third week of October, she applied for pip (well I did as she's struggling with speech etc) on the 28th October. She got the decision about two weeks ago, the only part we are confused about is the letter states that as she hadn't been affected for at least 3 months before the 28th October they cannot award the payments to start until the 28th January (obviously 3 months on from the claim date), but some of her family members are saying that's wrong and, if it's after 3 months affected, then the award should start from 3 months after the stroke happened which would be around the 6th December, we don't know if the hospital stay time doesn't count or if there's another reason, and I just wondered if anybody on here could give guidance as we don't want to unnecessarily phone and bother the pip people.

Sorry for such a long opening post and I hope it makes sense to somebody.

Hi @craig56 I've removed a post as it looked to be a duplicate but have made sure this post is in the right area so hopefully a member who has some experience will see this and be able to advise. There are a lot of knowledgeable people so I'm sure you'll hear something back soon. I hope your partners recovery is going ok.

    Best wishes,

    Hi,

You are correct, PIP is not paid while claimants are in hospital.

For existing claimants, PIP stops after 28 days in hospital.

For new claimants, PIP does not start until the day they leave hospital.

Thanks for that Holly. Her recovery is slow but I think she's doing well regarding the stroke (obviously she gets more frustrated), she has an additional issue with leg circulation which we're just trying to get sorted, hopefully that'll be soon and then she can push her exercises more.

I thought I'd heard that, thank you, saves us wasting the pip peoples time, we weren't expecting anything so anything they awarded was a bonus to us. She can now tell the overly helpful family members we've checked!
