My transitional payment has been stopped due to LCWRA, even though this was on my transitional application with a fit note for a whole year this was submitted date of application.

I received this message when I questioned USC.

Hi Leanne,

I have looked at the way your claim has been calculated and I am asking that the transitional protection team look at re-calculating the protection amount as this has been removed due to the LCWRA award being added later.

However this starts from the start of your claim so Transitional protection should be re-calculated to allow for this.

Please see Barry's note this was part of the change to usc as a requirement, therefore shouldn't affect my transitional protection, nor was I advised it would affect it.


I was advised by Barry that this has been sent for recalculating

    I'm afraid to say that it is correct that your TP erodes by the same amount as the LCWRA element, even though you provided a fit note at the start of your UC claim. Unfortunately, it's the law.

    How much was your Transitional Protection?

    TP is designed so that at the point of transfer from legacy benefits, you aren't worse off.

    This erodes over time with the annual benefit uprating or with the addition of a new element.

    You have been awarded LCWRA after your transfer so it is correct that it reduces/stops your TP.
