Pip refused after renewal

Hello
my husband had a renewal form which we filled out and also said no change on it , he had telephone interview and my husband answered all questions that were the same as he put in the form that the telephone person asked him but the person has made the opinion that my husband did not answer as he did. Hes made a mandatory reconsideration just now as he just got letter this afternoon.

I’m not sure if this is normal or not?! I’m just looking for kind replies or reassurance please.

When he filled out the forms, did he just write "no change" and nothing else?For the MR i'd advise you to put the request in writing stating where and why he thinks he should have scored those points. Include a couple of real world examples of exactly what happened the last time he attempted each descriptor that applies to him. Give detailed information such as where he was, what exactly happened, did anyone see it and what the consequences were. You should aim for at least half an A4 side of paper per descriptor that applies to him.The most likely outcome will be the decision remains the same. If you're not happy then you can proceed to Tribunal.1

Also my husband did MR over phone about 5pm ish today and they said someone will look at it again and get back to him, should we do it on paper too? The lady asked him why he thought he should get points that they turned him down on etc

MR requests should always be put into writing. Ringing to request it means that the timescale has already started so if you need to send extra evidence they may not receive it in time before the decision is made. Also, you're relying on the person typing what you've told them and there's no guarantee that will do this correctly.

Hi MR came back as refusing still so appeal will be done, cab hopefully helping. We don’t have printed original form from when he was successful the first time he received pip before this review, is there a way to get his form from anywhere or no? Im just on phone now asking them for original successful award letter so we can see what points he got last time weather that’s helpful or not it’ll be good to see as my husband misplaced that letter from 3/4 years ago.Thanks for your kindness & support0

Just got off phone after 45 mins holding , man seemed helpful. Sending the original pip award (2016)with scores, his 1st review which we’d forgotten he had and was successful back then (2018) and the original forms we sent them which is good I think.Just waiting for CAB to get back to us. I’ve filled in appeal so far & saved it so we can go back to it.0

@dannistar - what you are going through is what keeps me up at night waiting for my own result
someone needs to explain to me why if nothing changed you lose an award/get less points than before?
On your previous award did you only just have enough points for a standard award or did you have points to spare/an enhanced award
surely a tribunal judge would have similar logic? (the mods would be able to correct me on this)1 -
Hi, it’s very stressful, we have 5 children, 3 of which have various special needs so life is a lot without this on top but anyway yes I do not understand the logic of it either but we will fight on!On his previous successful award he received standard for both.Hope your own journey is more positive than ours.0

getting copies of your 2016 and 2018 assessor reports + point breakdown will be vital when comparing to your recent failed report
also who came out of the pandemic better than they went in it? Especially for those with pre-existing conditions
For me that provided a lot of stuff to potentially put on the review - I was once told that you need to try and write things on the review and avoid putting ‘no change’ if possible
i think you may be able to submit new evidence right up to a tribunal (can a mod confirm that?)

I can't agree with concentrating wholly on any assessment report. It's fine to point out a couple of obvious errors but then put the report to one side and move on. Make sure you tell them which descriptors you think apply and your reasons why. Include those real world examples. These examples are what got me 3 consecutive paper based assessments for PIP reviews.If it gets to Tribunal they already know that some assessment reports are flawed so you don't need to point that out to them as it won't get you a PIP award.Yes you can include more evidence. What they won't do is take into consideration any worsening of condition.1

Poppy - I honestly thought that was a given and they already did that but I totally agree with you if that wasn’t done
so perhaps after highlighting each part of the assessor report you felt was wrong use a real world example(s) to demonstrate why you should have gotten a specific point and any further evidence if you have it
but use the opportunity to expand on stuff you’ve already submitted- does that seem fair?1 -
