    Well I have finally got the MR done and sent off today, I have followed the brilliant advice I was given here, and it’s done now …….there is nothing more I can do.

    I think I have done ok but it was tough being sure to cover everything I wanted to so… the wait begins!!!!!

    Had letter stating they received MR request and we have 1 month to send in any additional supporting evidence……. We don’t have anything further as nothing else to add, they have everything from the application stage, plus I have been very clear with the MR as advised here, so the wait continues!!!!!!!!

    Well well the dreaded MR decision letter has arrived…….they upheld the decision so no change, so still got 6 points for daily living and 8 points for mobility = no daily living and standard mobility.

    So very disappointing and now have to face the appeal process.

    I have just registered and started the online appeal, but it’s asking for the reasons we disagree with the MR?

    Don't know what to write here as the MR explained everything we were disagreeing about and was detailed etc, can anyone advise please?

    It's not surprising the decision didn't change because most don't at this stage. For the Tribunal, you just need to give a brief reason why you disagree with the decision. Anything else can be done at a later date, if needed.

    Once you've submitted the appeal DWP will be given a timescale in which to respond by. They often don't respond by that time but don't worry, HMCTS will extend that time. They will eventually respond. Before doing this a decision maker will review your claim again. Sometimes (though rarely) they may make an offer at this stage but please don't expect that to happen because it is rare.

    The only downside to a Tribunal is the waiting times can be 7+ months. Please also make sure you choose to either appear in person or have a telephone/video hearing because either of those will give about a 68% chance of success.

    Thank you both for your responses, I just feel that I have already done everything that I can and said in the initial claim, and then in much more detailed MR, where I went over each section and give examples of why he meets each relevant descriptor.

    I will go over it again and once again give the same information explaining what we disagree with and which descriptor.

    Do they get copies of everything from DWP like the Claim form, evidence and MR request etc, or do I need to upload all of that too?

    You don't need to go through everything again, which is why i advised to just give a brief reason. HMCTS will be sent everything you sent to support the claim. You will then be sent everything in the "bundle" which will include the PIP form, assessment report, all extra evidence, MR request letter and DWPs response.

    I understand you said give a brief description but when your new to all this, it’s very daunting in case you don’t put everything you need, and miss an opportunity, that’s why I asked clarification, because I’m just duplicating myself from what I wrote on MR. 

    It’s difficult being brief when there is a lot to cover, but I will try to be as brief as I can, and I’m glad they do get to see everything to do with claim.

    Tribunal appeal now done online, hopefully done it right.

    Just got to wait now, however long it takes?

    Update…..

    Just had a phone call from DWP regarding my husband’s claim and tribunal appeal.

    She explained she was looking at his claim for the first time as requested by tribunal, she asked me loads of questions about his needs and the things he can’t do and what I support him with….call lasted 35 min.

    She was very nice and I honestly felt she was simply clarifying where she could consider awarding more points…….

    She has increased his award to enhanced for both daily living (previously no award) and mobility (previously low rate), she explained he now has more than enough for advanced award after her assessment today.

    She explained that the assessor had concentrated on mobility side and not all aspects……and had missed some things.

    Said award will be backdated and will be in bank 3 - 5 days, and hen he will be paid every 4 weeks, she will send letter today explaining everything. She is going to stop the appeal as no point now enhanced awarded….and will notify tribunal.

    I can’t begin to explain how relieved we are, the call was out of the blue, I coughed my way through it as have very bad chest infection, but she was very nice to speak to and seemed to understand his issues.

    Just so happy that we don’t have a tribunal to face……can’t believe it.

    Further update …… backpay paid into bank 28th November, and today received new paperwork from pip.

    Daily living - 21 pts from 6.
    Mobility - 20 points from 8.

    Ongoing award, which I had to check what that meant, very pleased and can stop worrying now.

    Thank you for all the help and advice given, this forum is just invaluable.

    Thank you so much, it is a big relief, and good to experience a DM who understood and was really understanding.

    I think it’s good for other people to see that things can work out.
