Been rejected by council regards disability tax relief

I am living in 1 bed house.need to climb on stairs since I open the door as my house is allocated up the arch of building.then is my kitchen wit tiny living space sofa where my carer sleep .another stairs up to my room and toilet. Toilet doesn’t have door .is arch again .I sleep upstairs so is not really separate room for me.?
counil disagree do they are right ?

Council Tax – Disabled Persons Relief

 

I refer to your recent application form for disabled person’s relief.

 

The criteria that is used for the qualification of this discount is that you must have either -:

 

a)    a room which is not a bathroom, kitchen or a lavatory and which is predominantly used (whether for providing therapy or otherwise) by and is required for meeting the needs of a disabled person resident in the property,

b)    a bathroom or kitchen which is not the only bathroom or kitchen within the property and which is required for meeting the needs of a disabled person resident in the property; or

c)    Sufficient floor space to permit the use of a wheel chair required for meeting the needs of a disabled person resident in the property.

 

I understand from your communication with the Property Taxation Inspector that you have none of the above facilities provided.  The additional room indicated was a bedroom; unfortunately this is not an additional room as everyone requires a bedroom whether disabled or not. I am therefore unable to grant the disabled person’s relief. 

 

You have the right to appeal against this decision.  In the first instance you must write to the Revenues & Benefits Manager, within the next 14 days, giving good reason as to why you believe the relief should be granted and supplying any other relevant information that you wish to be considered in this matter.

    What exactly are you applying for? I'm a little confused by your post because you say council tax band reduction but the reply from your local Authority was regarding a bedroom. A band reduction is where they lower you council tax band by one or if you're already band A they will give you a 17% discount on your council tax.     Hi @octopuscat, it sounds like you're applying for council tax reduction. They do have criteria that you have to meet though, there's more information here Council Tax reduction | Disability charity Scope UK.

    If you're trying to save money, like so many of us in this current economic climate, we have a help section here Advice and support | Disability charity Scope UK. It can be quite frustrating when we're living in such a poor situation where our carer is having to sleep on a sofa and we aren't sure what help is available to us. 

    Turn2Us has a section on possible benefits to help Your situation - Turn2us. I hope you can find one that fits your situation if Council Tax Reduction does indeed not fit your situation.

     yes I do applied for  Band reduction  for disabled people but they declined

    And yes i eligible for 2 bed lha rate  as person on pip with carer stay over.

    From what you are saying did you inform the council that the bedroom you use was the extra room required for your disability, or the room your carer has to stay in overnight is, as the only place for them to sleep is the living room space?

    Could you clarify which benefit you are trying to get as well? I believe the 2 bed lha rate is different from the council tax reduction for a disability where the property also meets the 3 criteria.

    You will only be entitled to this if one of the following apply.
    • have a room (other than a bathroom, kitchen or toilet) which is used to meet your needs e.g. for the purposes of dialysis, treatment or for the storage of equipment
    • have a second bathroom or kitchen used to meet your needs
    • have enough space in your home to use a wheelchair indoors

    If any of these apply, the bill for your dwelling is reduced to the next lowest band. Being disabled doesn't automatically entitle you to this.

    The reply from your LA indicated that you said you needed it because of the extra bedroom  but this doesn't entitle you to the band reduction.

    I have only 1 bedroom which I use for myself .got cap breathing mashine due to sleep apnea LHa is different as person who got carer and is on Pip is entitled for higer rate of housing .

    I know an extra bedroom for a carer is different but based on your home I can’t see how you could be entitled to a band reduction in your council tax.
