Is it because the work allowance is the lcwra rate is that where im getting confused.. had it off been on i wouldnt of lost as much is that what you mean ?
Also i thought you werent entitled to it in first 3 months so why would i be owed thats congusing too.. im so sorry its all new to me but i need to know for when they try to riggle out of anything im owed0 -
The work allowance is an amount of money you can receive in earnings before they deduct money from your UC. It's different to the LCWRA element.
When you're found to have LCWRA this will apply from the date you provided your first fit note. The work allowance will apply from that assessment period, which for you is 10th Dec to 9th January. If you had deductions in this assessment period for earnings then they will owe you some money.
If no further deductions were made in the following assessment periods then it will just be for that month that you're owed money. See link. work-allowance-universal-credit
If you or a partner have no earnings going forward then the work allowance will be irrelevant now anyway.
You then have to wait 3 full assessment periods for the LCWRA element, which is known as the relevant period. It is then paid from the 4th month with first payment being the end of that month because UC is paid 1 month in arrears.

I do understand that what i dont understand is what you mean when you say im owed money for them months i had earnings if the element isnt applied till the 4 month ... so basically they do give you backpay as if the element for had lcwra had been on0

I had deduction upto march payment as obviously its in arrears0

If its applied from first sick note ... then obviously people get backpay otherwise it doesnt make sense0

There will also be some people that haven't received any earnings so having the work allowance applied makes no difference.
The work allowance and LCWRA are 2 completely different things. There's 2 levels of work allowances, if you don't claim for help with the rent it's a higher allowance, it's lower if you claim for help with the rent.0 -
So i understand it as ... because they took money off me because of my earnings during those assement periods now im on lcwra thry shouldnt have is that correct and the lcwra is allowed on the 3 waiting months if you were earning ?0

So my universal credit is 691 per month the lcwra is 419 i think so thsts what im entitled to everymonth
So from jan till now i get the difference back because i had earnings0 -
They owe you money because the work allowance now applies and you received earnings. They do not owe you money because of the LCWRA element. What assessment periods exactly did you receive earnings for?
The LCWRA element is £416.19/month, which should be included in your next statement but you will need to check. As your next payment is 16th of this month you will also see the increase in your standard allowance and housing element (if entitled)0 -

Ok ive read it and im stil at a loss ... i guess i will just have to wait and see ... i doubt they will pay me anything for then months i had earnings because they will think i dont know anything about it ... glad i got some advice in case they try

You're welcome. UC is definitely not the easiest of benefits to understand. It's taken me many years to gain the knowledge I have.
They will pay what is owed to you but before they do that they need to recalculate your past statements to work out how much you've already been paid, against what you should have been paid. You will then receive the difference between the two. Once that's done you'll receive a letter on your journal telling you how much is owed and it will be paid into your bank.
The new statements will also replace your existing ones so you may want to take copies of those.0 -
I hope so ... my understanding is now my earnings in one of the assement period was 1200 then i used to x that by .55 then i knew how much uc id get ... now the work allowance is applied im gueesing it would be 800 x.55 ... so its the difference between these two figures you mean i will get back becwuse work allowance is 404 just rough figures0

£404 is the new April increase amount. Before the increase it was £379/month. If in one AP your earnings were £1,200 then your deductions should have been as follows.. £1,200 - £379 = £821 x 0.55 = £451.55
Before the work allowance earnings of £1,200 would have reduced your UC by £660. Therefore for that month you will be owed the difference between those two. £660 - £451.55 = £208.45 (owed)0 -
Can i ask i think this is where im going wrong ... so once my sick notes are in continous from 4th of jan they give me the work allowance if im assessed with lcwra from then not just from the 4 month is that correct0
