LCWRA BACKPAY
Hi, I was awarded LCW in 2021, in 2023 I wanted to try and apply for LCWRA so I wrote in my journal "How do I get the form to apply" which they responded I have to print it out myself from the gov website which I did and completed fully with supporting documents.
In June 2024 I was infomed that I would be having a telephone assessment for my limited capability for work, following the phone call I was awarded LCWRA.
I recieved my first payment without any back pay so I called up and they told me that I wouldn't be awarded any back pay and that this was just standard procedure following the renewal of my 2021 LCW award.
I called the health department who handle the document assessment forms which I had sent off in 2023 and they informed me that they have no record of it and without a referal directly from DWP it would've been disregarded and that I'd recieved the incorrect advice from my work coach.
Do I have any leg to stand on in trying to get a mandatory consideration for my start date to receive some back pay?

Independent Assessment Services who do the assessments are correct that a referral is needed and you can't just send a form off to them without that referral. I'm confused why your work coach advised you to download the form.
I'm also confused why you had an assessment when there was no referral made.
The correct procedure was for you to report changes to your health condition and provide fit notes to support that. You would have then been referred for a WCA and received the form in the post.
When you do that the extra money is paid from the assessment period in which you reported the changes. Money owed is always paid separately to your usual monthly money.
Do you have proof that they advised you to print it off and send it? If so then I'd advise you to use that proof as evidence of what you were advised to do and request a Mandatory Reconsideration on your journal.
