On the 13 11 24 my motabillty vehicle was impounded by the police @ the time I was being treated by The ambulance service and was transferred to hospital, the police said the vehicle was causing an obstruction and impounded it.

Motabillty have said because of the impound I've breached the agreement and the lease will be cancelled and they will collect the vehicle, they say I can't appeal the decision

Does anyone have any advice

Thank you.

I have no advice personally but could citizens advice or welfare rights help you with this? Surely they can’t do this, you have proof of why it happened and you weren’t at fault! So sorry your going through this 😔

I am sorry to hear about your situation. Based on the details you've provided, Motability has the authority to revoke contracts if a vehicle is used in a way that breaches their agreement, such as causing obstructions. Since Motability is regulated by the FCA and the FOS, you have the option to file a complaint if you believe Motability's actions were unfair.

It’s important to gather any evidence that supports your case. Start by obtaining a copy of the police report that explains why the vehicle was impounded. You should also provide medical records showing that you were receiving emergency treatment at the time. If possible, collect witness statements from the ambulance crew or any other professionals involved. These documents can strengthen your explanation and demonstrate that the incident was beyond your control.

The Financial Ombudsman Service can independently review your case, which might help if you feel Motability has not properly considered your circumstances. Their involvement could provide an impartial assessment and potentially lead to a more favourable resolution.

    Hi,

Does it definitely say you can't challenge the decision on the letter?

It does say they'll look at each case on an individual basis on the website.

You may need to contact someone higher up at Motability than just the standard call centre staff.

The conversation I've had with the case manager on the phone with just says I need to wait for the letter that will tell me when to return the vehicle

    Thanks

There should be information on the letter about how to appeal the decision.

Some forum members have also had good results contacting someone high up at Motability. Unfortunately I can't remember exactly which person it was but they had a direct email I believe.
