LCWRA and TP Case

Has any decision been made on this case?

I read on here about being worse off if swapping from Carer to LCWRA due to losing the TP, so I asked not to continue my assessment for LCWRA. However, should this case be successful, I will ask to start the claim again.
I also wonder if they would go from when I reapplied for LCWRA or the date of the first fit note since they have continued to ask for Fit notes which I have continued to supply.

    No decision has been made as far as I'm aware. You need to be cautious about continuing to provide fit notes because they could go ahead with the work capability assessment. Have you been referred and received the UC50 form yet?

    Even if the Upper Tribunal rule in the favour of the claimants, it could still be a very long time before any changes are made, as that's usually the case with things like this.

    Edit, I see you've already returned the UC50 form back in Oct last year. It seems rather odd that you've asked not to continue with the WCA but you continue to provide fit notes.

    I believe the only reason I am still being asked to provide fit notes is because no one has bothered to look back and see I requested to not continue the assessment. However, I will continue to provide them just in case it may go in my favour at a later date.

    I'm sorry but this sounds a little odd to me. Have you had official confirmation that it's actually be cancelled?

    It says they have in my journal.

    I would take a screenshot of that. Have you also contacted the health assessment providers to tell them you want to cancel it? If not then you should do that because UC may not have done this. If you don't know who does them in your area you can find details here.

    I still don't think that continuing to provide fit notes is right just because the upper Tribunal may rule in the claimants favour. By continuing to provide fit notes they could refer you again in the future and you can't have it both ways.
