I can't I'm afraid @Slopii as I'm leading today and have a lot of people needing support, so I don't have the time to research it. But it's it's a power derived from the anti-fraud legislation, that I can say with certainty.

So, they send me 2 text that they stopped my claim. They before review, many times I called to UC where I said why you put me as self employer, when I was not, did not work due illness the last 3 years and my ability was left from assesment to work 2 or 4 hours. They said ignore Self Employment Evidence, only bank statements and photo ID to provide. I went to local Job Centre, show them my passport and four months bank statements, they made a note, but did not agreed that they take photo, or aploud them. I'm.single mum of 1 child in education. person that does review send me the link where I can enclose my cilomplain. Next week they booked me Self Employment appointment, so don't know what's going. They fail to correct self employment mistake, said don't worry after 27 August 25 will disapair. Nothing said on my journal that I did show them.bank statements and photo ID. Below I attach the link that work reviewer enclosed to me. They fail to say what legislation they are using and I did not received personal chater nothing plus I borrowed loan, advanced payment from UC, so don't know what to do.

Is anyone knows what legislation is on 38(3) and (2)

What gives DWP the legal right to review a Universal Credit (UC) claim?Universal Credit Claim Reviews (UCR) operates through legal powers, namely Part 3 of The Universal Credit, Personal Independence Payment, Jobseeker's Allowance and Employment and Support Allowance (Claims and Payments) Regulations 2013 https://legislation.gov.uk (opens in new tab) (Reg 38(2)). These legal powers allow the department to request information or evidence in relation to an ongoing award of benefit.Do claimants have to participate in the Universal Credit Claim Review (UCR) and provide information, if requested?Claimants must participate in a UC claim review and provide evidence if requested. Failure to participate or provide supporting evidence when requested may result in UC payments being suspended and the claim potentially closed

All this caterwauling and non compliance. If I was a DWP investigator, I would be very interested to know why.

Just my opinion, but we are in receipt of state benefits, and it doesn't seem like a good idea to rock the boat.

Section 38(2) provides an exemption from the duty to confirm or deny whether information is held if doing so would or would be likely to endanger the physical or mental health or safety of any individual.

These exemptions are subject to the public interest test.

Section 38 (2) is not for bank statements or photo ID. As well it says on UC should be provided if requested. I did provide in face to face appoitment, but only did not allowed then take photo, or aplouded myself, as this personal data, it is breach of every person privacy

So they stopped my claimant unlawfully. They did changed in my circumstances on July. And when there is changes you need again, only provide document if they ask! By this mistake, they put another error as self employment appointment, bank statements, ID! When photo ID has nothing to do with it! Read what UC part 13 means Part 3 of the Universal Credit (UC) regulations, specifically within The Universal Credit Regulations 2013, deals with evidence, information, and the notification of changes of circumstances that may affect a claim. This section covers what information and evidence a claimant must provide, how they should report any changes to their situation, and the various requirements related to the evidence needed for a UC claim to be processed accurately. They change my circumstances in secret, to ask for documents on 28 July 25. The documents to provide only if needed and circumstances changes, so that's what UC is doing..I did provide in person, but tney ignored, and ask for photo ID, when this absolutely as nothing to do on UC part 13 and legislative 38 (2). That is for sick people

@Albus^Scope, I tool a photos what they do..they called me with 24 hours urgent apoitment when mine post to be only by phone. UC part 13 says only to provide documents if there was reported changes. I have no changes! They wrote what ever they want for purpose. For what reasons these massive reviews! Because every Claimants must to read what they did for purpose mistakes to do these reviews. It doesbr say Legislation 38(2) about passport and Bank Statement! UC part 13 it doesn't say that should be forcement to provide photo ID and Bank Statement. It doesn't that they shouldn't not be accepted if they brought them to show. So what you say now?
