good afternoon.

I’m new on here and was hoping someone can advise me please. I am a full time carer for my father and work part time in evenings. I claim UC and get the carers element. I’m due to go in hospital to have total hip replacement and Iv been reading that I won’t be able to drive or do much for around 6 weeks. Iv been advised that I will have to cancel the carers element on my UC claim, which is understandable. I will be getting SSP from my employer. I was just wondering if I can claim LCW for the time I am off? I appreciate everyone is different in their recovery time, but I’m also worried that it could possibly be longer than 6 weeks im off work as I do a semi manual job and will be standing & having to lift things.

Any advice would be greatly appreciated. Thank you

To start the work capability assessment process off you will need to report your health condition and provide a fit note within 7 days of that. You must continue to provide them without any gaps.

Usually around 29 days later you will be referred for the work capability assessment. Once this is done you'll receive a letter on your journal telling you that you have been referred. A few days later you will receive the UC50 form in the post. This must be filled in and returned with all your additional evidence.

You may need an assessment because most people have them. The timescale for this could be 6 months, sometimes longer.

If found to have LCWRA you'll be entitled to extra money from the 4th month after you provided your first fit note. However, the same person can't receive both carers element and the LCWRA element at the same time and only the higher element would be paid.

If you're also claiming UC with a partner that already receives the LCWRA element on your claim then you won't be entitled to any extra money.
