    Thank you i just had a quick look on Google and it said if your eligible your claim will get it automatically but we haven't been given it automatically. Really appreciate both of your help thank you x

    Just saw this i think the reason why we don't get it already is cause the limited capability to work element we already get for myself being in esa contributions and pip

    In a couples UC claim the maximum entitlement is:

    1x LCWRA

    PLUS

    1x Carers Element

    The same person cannot get both, which is why Morgan and I have been saying your partner can claim Carers Element.

    You haven't been getting it automatically as he hasn't reported caring for someone.

    Once that report is made you will receive it automatically.

    Ok thank you is there anyone from dwp you can talk to on the phone ideally about this and other question I have do you no please? You have both been amazing thank you I have got rid of the brain fog I've had the last few days now

    The UC helpline are just call centre staff reading from a screen. They often give incorrect advice.

    Instead I would recommend contacting a local welfare rights organisation.

    Thank you. One last thing if they do accept and add the CE could I ask them to back pay or no? As I've been claiming pip since either I claimed uc which uc has been claimed from 09 2022 would they back pay if I asked or no? Thanks

    Yes you can ask for backpay. It would go to a Decision Maker to decide whether to say yes or no.

    If they say no you can ask them to look again at that decision (known as Mandatory Reconsideration).

    If they still say no, you can go to an appeal tribunal.

    I have seen others on the forum granted several years of CE backpay.

    Any lump sum you receive in backpay would be excluded from calculation of your UC capital for one year.

    Oh wow I wonder if they will say well you didn't apply for it till now so why now are you only asking for back pay (if awarded ) i first started getting uc in 09/2022 I thought they would only back pay for 3 months x

    You would simply say you were not aware you were eligible for Carers Element.

    It won't be an inquisition or anything like that.

    He should claim asap, there are no work restrictions on being eligible for Carers Element.

    If he is caring for you 35+ hours a week then he qualifies.

    Those work restrictions you are thinking of only apply to Carers Allowance.

    Thank you both I've put in for it on my partners log in I put he started caring for me since the first day I got pip awarded which was 30/12/2019 ino they won't back date that far although I have asked them to in a journal note under payments. Do u think we will get in trouble for only reporting this change now cause honestly we haven't known about it till you told me. As they say you can have your payment stopped or owe money

    Hi ladies I've just had this reply from uc on my journal saying to read the attached letter but it don't say if there accepting me for the carer element or not or what the next steps are any advice please x

    My other half don't claim any of the benefits on the letter so I'm not sure what they mean

    It's confirmation that CE has been claimed, you should see the element on your next statement and that will be your confirmation that the claim has been successful.

    Unless something is added on your To Do list you just sit and wait to see your next statement.

    Oh wow thank you so much if it wasn't for you both I've would of never of known about this it will be a big help us just had a journal message for my parnter saying the below.

    I have today referred your request for the Carer element to be considered from an earlier date to a Decision Maker.I am not able to give a date as to when the decision will be made, but once it is you shall be notified via your journal.Regards
