hence the trend for more 2 year awards at 79% 13% over 2 years and 7% ongoing they were not going to get caught out like they have with the transitional protection scheme putting all benefits onto uc and paying more

Won't it be what Kendall came out with last week in the green paper that hopefully will be watered down over time

hi, so I’m on PIP with extra severe disability top ups (so basically the top level) yet I have only 3 points in several sections-not 4 in any(to be paid for an ‘ongoing period’). Will I be reassessed before the 10 year point (which will be in 8 yrs time)?
I’m also on ESA support group(I’m 62). Will the support group also be reassessed?
Thanks to anyone who can clarify 😘

I don't know until tomorrow.
Its on for an hour and a half so I presume its more than what Kendal said.

This might be of interest to those on ADP in Scotland

I can see two MPs who are fairly local to me, but not my MP. They are newbies.
I'd happily bet my home on the fact they will NEVER be re-elected in those constituencies with this stance.
Still, they'll get their pension for their for however many years Labour hang on to power, so that's okay then. 🙄

Yeh but there's a lot of other stuff so maybe what Kendall said amongst the rest. Hopefully no more stress 🙏

as far as info disclosed: PIP reassessments will happen when they are due. So yours will happen in 7-8 years
Regarding ESA CB, WCA will be scrapped by 2028, if you will be reassessed by then no one knows.
After that, at the moment the green paper it’s unclear who will be affected by the proposed changes.
PS:
Anyone with ESA contribution based, if that proposal goes ahead, might lose their entitlement eventually. Its not very clearly written.
As well as any NI contributions for their future pension.
So if you are on ESA contributions based I would reply to their green paper pointing that out.

Can Labour actually ban certain illnesses/disabilities from being eligible to claim PIP? I don't think so if they're under the umbrella of the Equalities Act 2010.
Any changes to benefits like Employment and Support Allowance, PIP and Universal Credit must adhere to the principles outlined in the Equality Act 2010. Correct me if I'm wrong.
I should study law in regards of disability rights, surely Mr Human Rights Lawyer Starmer knows all of this?

they’ll try next parliament.
They want to change the descriptors after these changes go through.
And I’m sure they will go ahead even if they have to change the equality act.
There are going to be more and more cuts cause they have a huge amount of debt, with higher interest rates than 5 years ago and they don’t want to tax the rich and it will worsen very quickly that’s my take on things

I expect they will try to but the thing about PIP is it has never been about which disability you have but how it affects your everyday life. No two people are the same so people with the same diagnosis can have very different experiences. Some conditions are mild and some are severe so to try and ban any condition is wrong but I do expect them to try to make the new PIP regulations so strict that it will naturally exclude many people who currently qualify for the daily living component of PIP. In my opinion it is a human rights violation and if enacted it will leave so many people not eligible for PIP or the health element of UC ( Currently called LCWRA )

They can't legally. That's not to say that they may or may not try. However, if they did try to do something like that, there would be a significant uproar not only from the public, but from their own MPs like there is already. Organisations like the UN would also be prompted to get involved as it would be a direct breach of the Human Rights Treaty. The UN are already looking at this situation if that's of any help.

Lcwra reviews. I have asked universal credit how long was my lcwra is awarded. Replied saying 16 months and said it's due to be reviewed 2025 September. How likely will I have to have a review this year?!

I think the number of individuals that will lose will be more like 2 million but the government will lie and say it is much less. The casualties of the 4 point rule will be casatrophic. Especially for people who are up for review.
