I'd like to dispute the award length only. How long do I have to do this?

Hi @mikehughescq
I just wanted to post a quick reminder that sarcasm directed towards, and at the expense of, another member is not something we condone on the community. It may come across as disrespectful and otherwise inappropriate, and isn't relevant or suitable in a thread like this one.
I'd like to remind you of our community house rules, which detail that we want the community to be a safe and supportive place. Please make sure your messages respect others’ views and suggestions, even if you do not agree with them, and please be mindful of what you say. Not everyone shares the same sense of humour and this may be misinterpreted as a personal attack or comment towards another member.0 -
Hi forgot to ask is it worth sending a copy of this aswell to tribunal?

I'm not sure why you would want to send that. Mike has covered everything you need and you won't go far wrong if you listen to his advice. Good luck!

Note to readers of this thread: I've split off some comments to a different thread to try and keep this discussion relevant to questions by @ncor. This is why some comments might seem as though they're lacking context.1

The reason I ask as I was reading similar threads to my own and it was mentioned that this guidance should be included to the tribunal.

Thanks again for the advice and reassurance.0 -
No problem thank you again.1

Thanks very much, greatly appreciated. The advice on this forum is great and I don’t think I would have pushed my appeal to tribunal without it. Just a waiting game now and will keep you all updated.
Hope you are doing well also and take care.1 -
Thank you very much for your kind words, really appreciate it. It was hard and still is but just got to push on through. Speak soon.1

Just an update.
PIP rang today out of the blue and have offered to extend my award length from 2 years 6 months to 4 years. I was caught off guard by the call wasn’t able to give an answer there and then.
I have to ring back and let them know, they did say if I felt it wasn’t long enough that I could take it to tribunal, not sure I have the will to do that.
Asking for some advice. Do you think I could ring the decision maker back and ask for a longer award instead of going to tribunal?
also do you think PIP knows they are going to lose at tribunal and that’s why they have offered this?
any advice would be much appreciated.
Thanks.0 -
DWP will almost always give either a shorter award length or a lower award, if they ring to make an offer before a hearing takes place. I'd advise you to continue to Tribunal because you have nothing to lose.

They are ringing back tomorrow and will build myself up to get these points across on the phone, if they still disagree then I will tell them thanks, but no thanks and will see you at tribunal.
I really do appreciate the advice, would be lost without it. Will keep you all updated thanks again.1 -
PIP have just phoned again this morning.
They told me the reason they are offering a this length of award and not a 10 year award is that a lot of the daily living activity points were scored for mental health for prompting.
I asked for the specific piece/pieces of evidence to used to justify this award length, he couldn’t give me a direct answer.
They think because of my age, 24, that with specialist input I would get better. I said I have had plenty of specialist input in the past, evidence provided to prove this and its hasn’t helped.
I told him I have had my conditions for 10 years and he said they did look at that.
I told him I would be happy with nothing less than a 10 year/ongoing award.
He still didn’t change his offer so I told him I would see them at tribunal, he said that’s fine they will start preparing the appeal submission to send to HMCTS.0 -
Okay thanks for the advice, where could I find the guidance to have with me on the day?
Also am I able to request a phone tribunal? As one of my main triggers for my anxiety/panic attacks is going outside of my own home.
lastly would you know roughly how long I may have to wait for a tribunal date?
Thanks.0 -
A very interesting thread, I've always found Mike to be very informative. I've been awarded for 5 years twice and I've been wondering if it would be possible for me to be awarded for 10 based on the fact that treatment hasn't helped me and it's been acknowledged twice by the DWP that I won't get better any time soon.
I shall be following this closely
I hope it goes well for you @ncor

Thanks everyone and yes just realised @Username_removed about the guidance, will print that off and have with me.
Does anyone know how long I may have to wait for a date? Also am I able to request a phone tribunal rather than face to face?
Thanks.0 -
Hi all,
I've removed some comments from this thread that contained misinformation. This is something we're taking action on. For transparency: I've also removed a couple of other comments and a segment of one other comment, not because they broke any rules in themselves but because they didn't make sense without the context of the removed comments.0 -

@Username_removed
I appreciate you greatly and I am sorry you have felt offended by one of your fans. Please don't allow the frustration of other people discourage you from continuing the good work. I am always learning from you here, you are a God sent.
On the topic and in my humble opinion, I always state at the onset as to why I think should be awarded for a specific length. And if the DWP don't have evidence in the contrary, they grant my request.0
