Severe Disability Premium, state pension, and Carer's Allowance

My State Pension began in May of this year and consequently, my Carer's Allowance ended. I am getting the underlying entitlement to Carer's Allowance and was told by an adviser at the DWP that I cannot get the Severe Disability Premium due to the underlying Carer's Allowance. I fulfill the criteria in all other respects such as PIP award and Housing Benefit. Seems so unfair. I have now given up on my claim for SDP. It appears that an underlying entitlement to CA acts in precisely the same way as being in receipt of the full award of CA.

    Who is the SDP for?  Yourself or the person you care for?  

    I get State Pension and have  underlying entitlement to Carer's Allowance for looking after my husband who has PIP daily living. 

    I receive Attendance Allowance and no one claims Carer's Allowance for looking after me.

    We both receive an SDP in our Pension Credit claim plus a Carer's Premium. 

    Perhaps you could explain your situation a little more clearly.

    My question is simple. Does an underlying entitlement to Carer's Allowance prevent a claim for Severe Disability Premium? I have already explained that I fulfill the criteria for a claim for SDP but that my underlying entitlement to CA prevents the claim. Please allow someone more capable than yourself to answer my question. With respect, you are not doing any good with such a reply.

    @Lin56 sorry but that's a bit harsh on someone who was trying to help you regardless of if they didnt answer your question they explained their situation 

    It helps to be appreciative of anyone who takes time out to try and help.

    I think your reply was rather harsh. Shirely was simply trying to help you here.
    Your wife's ESA should include the couples SDP (£138.80/week)  and the carers premium £38.85/week. Having an underlying entitlement to carers allowance doesn't affect entitlement to SDP.

    Which is exactly what Shirely has advised. The only difference here is that Shirely is claiming pension credit.

    Apologies if I sounded harsh.  This was not my intention.   Just annoyed at the fact that receiving the underlying Carer's Allowance prevents me from claiming the Severe Disability Premium.   Once again, apologies for my reply was harsh as it was never intended to be.  I know that people here are caring and helpful.

    Somebody who is not being paid Carers Allowance would have no impact on SDP entitlement even though they have an underlying entitlement. 

    To save going through your past threads can you confirm who is living in your household and what benefits are being claimed.

    On the face of it you should be getting what poppy said
    Your wife's ESA should include the couples SDP (£138.80/week)  and the carers premium £38.85/week. Having an underlying entitlement to carers allowance doesn't affect entitlement to SDP. 
    In addition the ESA should include a pensioner premium if you are a pensioner which I seem to recall you are.

    If DWP have said one SDP cannot be paid due to the underlying entitlement to CA they are wrong and you should request a Mandatory Reconsideration of the decision.

    As advised in that thread
    Your wife's revised ESA award after you reach pension age should look like this
    couple allowance £121.05
    support component £40.60
    pensioner premium £117.05
    severe disability premium (couple) £138.80
    carer premium £38.85
    Maximum ESA = £456.35/week.

    It doesn't. ESA have got it wrong. The requirement for the SDP is that no one is receiving CA (or carer element of UC) for looking after the person getting the disability benefit. You aren't receiving it, therefore your wife is entitled to the SDP
    as advised in that earlier thread.

    My aim in answering your question was to show you that in my own case an underlying entitlement to Carer's Allowance did NOT stop the entitlement to the Severe Disability Premium.
