@Sue_Scope Lisa has 0reviously said her boss will not communicate via email or text or in any written form just verbal

Obviously trying to avoid any written evidence of what he is doing

You can only take work colleagues or union reps to any work meetings which is why I suggested the union rep attending

I understand Lisa is reluctant to upset her boss for fear of him dismissing

He seems to be or thinks he is above the law when it comes to employment

See how meeting goes but I really think it's time to gather your facts and report his actions either to the franchise ceo or immigration

@janer1967 thank you for this.  Lisa is it possible you can try and get in touch with the organistions I signposted you to?  In light of what janer1967 says just try to get through the meeting and make a note afterwards of everything thst is said.  I completely understand that you dont want to antagonise your boss.  Good luck for Wednesday !

@janer1967 never come across  employment where you get a phone call telling someone there hours are changed  because he only wanted one person working  but then put two foreign nationals in my place the company don't belive in allowing union reps to come to  meetings  my union said they can only intervene if my contract says different

The union rep said my old contract would still be in play  he hasn't given me a new contract I have asked four times for my contract  my boss told me to ask my manager I asked my manager for a copy and she said she had alot to do still haven't had it

I have given my boss the nights I can work so that I am offering alternative nights he is severely under staffed  he is using staff from his shops to cover shifts so they aren't on our rota but they are working back to back shifts 16hrs sometimes more  four staff have gone again this week  to be fair its over my head I don't even know if I have a work contract I get my pension so I am on the books unlike some of the others I have found out thst my boss is the owner and has several other business in wales and London

My manager messaged me to say that I have a meeting on Wednesday  she will be there the office is only small and no chairs so it will be uncomfortable as well as nerve wracking as when the others went in a meeting they were gone on the spot no working notice so realy worried now and if I can't get my contract if they do sack me  as my union rep said they can easily do another contract  and the union said they haven't been able to do anything to the company which is rontec its quite complicated and the union said staff are sacked or leave because they are made to feel they shouldn't be there  apparently its a large company with different owners that don't own it outright

@janer1967 the shifts my boss changed me to is because he sacked the one who did those shifts because  the person had Been off sick  so he sacked him @Sue_Scope I have spoken to acas  they said the same as the union if he doesn't put anything in writing its my word against his and I need to get my contract off him

    Lisa

Your situation is very complex and hard to advise on this kind of level without seeing the whole picture like a written case file if you understand what I mean

See what happens at the meeting and take it from there

They cannot refuse your right to representation  if it is an official meeting that could result in any action being taken I would also request notes to be taken or a recording that you can verify was a true reflection of what was said

Thank you everyone especially @janer1967 I went to my meeting my boss and my manager were there I was offered the chair as there was only one chair  my boss thanked me for comeing to the meeting,  my boss asked me to explain my situation which I did and he changed my hours with agreement of the carers to a Friday and Sunday night  so that I work a day  have a rest and work the next

My boss and my manager said I have years of experience and know employment law and didn't want to lose me as customers like me and on the nights I work I take more money he said I am permanent  staff and if I get any problems from any staff member  to speak to him the person I was working with Fridays and Saturdays  basically stabbed me in the back I will have someone else working with me until 2am I finish at 6am

Both my manager and my boss said that when they checked the ctv I have been doing my job unknown to me my boss was told I sat on the chair all night by the one I was working with but the truth came to light when they went through the cctv and was seen sleeping while I was doing the jobs and the week I was off sick he couldn't cope on his own and nothing was done yet he told my boss it didn't need two people

So all ok now thank you every one for your help that's one less stress gone

So glad it all worked out for you Lisa

Still concerned over your boss antics with those on student visa and his other employment practise

But you got what you want so no need to rock boat

However I would keep a record of everything you know has happened and anything else that raises alarm bells just in case you need it in the future

@janer1967 I am concerned aswel I will be eyes and ears the one  who was causing the problems is on a student visa I was so worried about loseing my job but I expect he knows what I would of done  and didn't want people poking around  as he also has other shops and another petrol station

I was trying not to laugh he was being so nice to me, but  on this occasion I had to think about my mum and myself and the consequences if I lost my job I am a strong beliver in karma especially when the students are still working full time when they go  back to university or when I eventually leave

Do you think they are actually going to uni I don't.  They will be on false documents showing their uni place etc

They can't be genuine when they arrive and get work accommodation  etc the day they arrive and if students would have waited till uni year starts

@janer1967 I know they aren't  all of them come into the country and start work straight away and they are all on a business management course  they all work full time and they don't appear on the rota  and some can't speak English very well and aren't well educated

If I report now I will lose my job it has caused me an awful lot of stress and made me feel poorly but at the moment I have my job which I realy need it isn't sitting well with me I want to report it but don't want to risk loseing my job

Hi Lisa, as we all know, you have to look after No1 first as nobody else will. Carry on looking after your mum and hold your head high as you should. Best wishes.

My union rep thinks he has checked me out and my qualifications and my work history  and he doesn't know what I know or if I know anything so he is probably worried so instead of asking questions I am just looking and listening I gave alot of information to my rep and he told me to keep my head down

It's not very discrete in the space of two months Welsh and English staff have been replaced with foreign nationals  and the two petrol stations with the same name which I cant say on here both owners are siri lanka and most staff are foreign nationals there aswel this is why its over my head I have been made aware that they are are paid less than minimum wage there is alot going on for just one person it could be wide spread across wales both owners also own shops and other petrol stations my boss owns 12 shops and another petrol station I wish I could undo what I know but I cant

I understand your frustration and agree keep your head down for now and just keep making observations

I would be more than happy to report if I had details

I hear you @Lisatho11987777, but you can't imo take on the world and the way things happen.
So be proud of what you are good at and try to keep your mum smiling. I lost my mum 7 years ago, and I would love to call her and just have a chat ant tell her all the things that happen.
    Take care
