    I would imagine it's like that because if it had been a lower award than your dla then you would owe them money 

    The way it is set is the only fair way

    DLA and PIP are different. If you were owed money for the difference between both awards then it would mean you were claiming both benefits at the same time but this isn't possible.

    That will be your first PIP payment because your PIP award starts from 9th November. However, 3 weeks of PIP at Enhanced for both parts is £470.70 and not £303.60 so i don't know how they reach that figure. Are you sure your PIP award is Enhanced for both parts?
    It is then paid 4 weeks in arrears. Your first 4 weekly payment will be Friday 30th December.
    Your DLA will be paid up until 8th November.
    If you want to know your DLA payments you will need to ring DLA because it won't tell you those on the PIP decision letter.

    Yes enhanced on both. I am going to send a letter starting the figures above and also disputing the back pay I still think I am entitled too. Will let you know the outcome.

    Scrap that. Worked it out I use my mobility element for my car.
    The care element is £92.40 a week, £13.20 a day. 
    So 9 nov - 1 dec is 23 days. 
    23 x £13.20 = £303.60. The amount they say they owe me.

    But still think that I should get the uplift from when I first applied and not from 9 November, so will be challenging it.

    As for challenging that, i'm afraid you will be wasting your time and theirs because it's in the legislation and can't be changed. It's been the rules since PIP was introduced in April 2013. No amount of challenging with MR and Tribunal will change that i'm afraid.

    In my opinion that doesn't follow. When PIP do a review if a lower award results they usually only make the change from when the decision is made (the exception is if they think claimant is failed to report a change knowing the change would reduce their award).

    DLA and PIP are different. If you were owed money for the difference between both awards then it would mean you were claiming both benefits at the same time but this isn't possible. 
    Again, I think they could have written the rules so that the PIP overwrote the DLA had they wished to.

    However there is nothing to dispute. The payments will be made in accordance with the procedure set out in the legislation. DWP have no discretion to do it differently.

    I called ESA today about SDP. They talked me through the form over the phone, and have to wait 2-3 weeks for the outcome.

    My 25 year old daughter lives with me and she also receives both elements of PIP.

    We live in a HA property which I am named as the sole tenant. They asked me if she pays rent, why, what difference does this make please?

    It doesn't matter whether she pays any rent or not because she also claims daily living PIP. If there's no other adults living with you then you will be entitled to SDP once your PIP is in payment, providing it's not New style ESA you're claiming.

    It doesn't matter whether she pays any rent or not because she also claims daily living PIP. If there's no other adults living with you then you will be entitled to SDP once your PIP is in payment, providing it's not New style ESA you're claiming.
