Hi Guys,
I’ve been awarded LCWRA got the letter in my journal today (sat) I pay the minimum amount off my debt as they overpaid me (there error)
im expecting about 7 months backpay (after the 3 months probationary)
so my question is I’ve got a arrangement in place to pay and it’s being deducted etc monthly. Will I lose my backpay as they’ll try to clear the debt?

The waiting period is 3 full assessment periods and then it's paid from the 4th month after you first reported your health condition, providing you sent a fit note within 7 days of that and continued to send them without any gaps until a decision was made. It's not paid at all during the waiting period. When it's paid from will depend on when you reported your health condition and what date you usually receive your money each month.Yes, they can recover any money you owe from the money they owe you. Although it was their error all overpayments are recoverable for UC. The money they owe you maybe sent to debt management before they pay you.0

So technically they can take the full amount of you owed it or is there a cap?I also note they say “may” be recoverable I wonder if there’s any circumstances where they won’t swallow it, I mean with the climate 2k odds would be handy!Thanks0

Yes they can take the full amount as there's no cap on what they can take. We've had members in the past where DWP have taken all the money they were owed for a debt. There's one good thing about it, you will no longer owe any money and there won't be any further deductions each month if they do take all of it.0
