LWCRA-Breach of the equality act 2010-Legal help required

Hi SC, I need some help, below is my formal complaint to the company Maximus in relation to the assessments, I have posted on here previously about my situation, which has been helpful, after years of abuse and torment from the DWP I have also logged an official complaint with them, I need someone who knows how I can resolve my issues or start the steps to take legal action towards these departments, my health has suffered greatly due to the ill-treatment going on for many years now, this needs to end otherwise there will be me in a box due to all of this :(
Any feedback on my complaint will be greatly appreciated.
To Whom It May Concern,
I am writing to formally file a complaint regarding the unfair treatment and breaches of the Equality Act 2010 that I experienced during my recent assessments conducted by Maximus on behalf of the Department for Work and Pensions (DWP). My treatment throughout this process has been unjust, and discriminatory, and has caused me significant distress.
Incident 1: False Claims About Phone Reception
On my first scheduled assessment, I was informed on the initial call that I could not take part in the evaluation from my car due to poor reception in my flat. So I needed to go up the road in my car to be able to undertake this call, This was completely false, as I looked online and found that your company uses an internet-based call service to make calls. There are no issues here with the internet, just the 4G/5G network, and I was fully able to participate. I believe this was an intentional act to prevent my assessment from taking place, causing unnecessary stress and delaying my claim. This constitutes a failure to provide reasonable adjustments, as required under the Equality Act 2010.
Additionally, I was later able to receive multiple calls while inside my flat, yet I was repeatedly told that my assessment could not go ahead due to poor reception. All calls are logged and recorded by me to demonstrate this contradiction. When questioned, the person handling the call was unable to explain how they could call me multiple times, yet the assessor allegedly could not call back as promised. Furthermore, I had clearly explained the poor reception issues and was assured that they would call back if the call dropped—yet this did not happen. This further indicates negligence and unfair treatment on your part.
This, along with the dismissive nature of the assessment, was exacerbated by the fact that during the few questions I was asked at the beginning, I was mocked for being out of PAYE work for seven years. The assessor failed to ask any further questions or acknowledge that I have been self-employed since 2018 through the Jobcentre scheme, which has consistently failed me over the years. The supposed commitment to helping people with disabilities find work is evidently misleading, as even when I have taken steps to do what I am capable of within the limits of my lifelong conditions, I have faced constant disregard. This includes my arm, shoulder, and wrist injuries sustained in 2017, which have caused me significant suffering over the years, yet have been continuously ignored along with my other conditions.
This along with being pushed on this call by the handler to come into the job center for the assessment, then a video call, etc everything to keep on pushing me to commit to this to ignore my conditions and my request for reasonable adjustments for my conditions, by way of doing my assessment on a telephone call.
Incident 2/2nd assessment: Gaslighting and Dismissive Treatment
During my second scheduled assessment, I was subjected to gaslighting tactics. My conditions were unfairly used against me, and the individual handling the assessment behaved in a manner that was dismissive and unprofessional. In addition, the assessor hung up on me during the evaluation, and I have received no follow-up response since. This has left me without clear information on the status of my claim, further exacerbating my distress and insecurity.
Due to my conditions, I often need to express my thoughts unfiltered. During the call, I merely pointed out the excessive waiting time, which was met with hostility from the assessor. Given the ongoing mistreatment I and many others have endured, I must state that the actions of your organization have contributed to immense suffering, with many disabled individuals even losing their lives due to this systematic neglect. Those who actively participate in this mistreatment for personal financial gain, at the expense of the most vulnerable in society, must recognize that the universe balances all actions. The harm inflicted upon the disabled and mentally ill communities will not go unanswered from the universe's law of balance, and the repercussions of such inhumane treatment will inevitably come back upon those responsible tenfold from the universe's law of action. The way you treat others will reflect back upon you all, and I urge you to reconsider your role in this ongoing injustice towards me and the wider disabled community by making positive changes in your lives from the ill-treatment you are putting out to the universe on a daily basis.
Breaches of the Equality Act 2010
The actions of DWP/Maximus have resulted in significant disadvantage to me, violating my rights under the Equality Act 2010, particularly:
- Failure to Make Reasonable Adjustments – I was denied the opportunity to participate in my assessment under reasonable circumstances.
- Discrimination Arising from Disability – My condition was unfairly used against me, leading to mistreatment and an unjustified delay in my assessment.
- Harassment and Detriment – The repeated failures in communication, misleading statements, and lack of follow-up have caused me undue stress and anxiety.
Requested Actions
- A full written explanation for why my assessments were mishandled.
- Immediate rescheduling of my assessment with clear guidelines ensuring fair and accessible treatment.
- An apology for the distress caused and confirmation that corrective measures will be taken to prevent this from happening again.
- A review into the conduct of the assessors/call handlers involved in my case to ensure that they adhere to fair and lawful practices.
If I do not receive a satisfactory response within a reasonable timeframe, I will escalate my complaint further, including taking this matter to the Independent Case Examiner, the Parliamentary and Health Service Ombudsman, or seeking legal advice regarding disability discrimination.
I look forward to your urgent response and a resolution to this matter.

Hi @DaveDave1, Sorry to hear about the way you were treated, it sounds like you've been through a lot. I'm afraid I can't give any advice on the legal side of things but just wanted to wish you luck with your complaint. I hope they're able to resolve some things for you and you get some closure for what you've experienced.

This is only the tip of the iceberg that I have written here. Am surprised I am still here, will keep pushing on, no longer can I stand by and let this happen to me and others with lifelong health conditions.

I’m truly sorry to hear about the challenges you’ve faced, and I admire your courage in standing up for yourself and others in similar situations. Your complaint is clearly written and effectively outlines your concerns.
To strengthen your case, I would recommend specifying a clear timeline for a response. For example, you could state: “I expect a response within 14 working days, otherwise, I will escalate the complaint to the Independent Case Examiner (ICE).” If Maximus fails to address your complaint satisfactorily within this timeframe, you can escalate it to the ICE, as their failure to respond will be treated as a failure to resolve the matter through their internal process.
If you do not receive a satisfactory resolution after engaging with the ICE, you can then take your case to the Parliamentary and Health Service Ombudsman, who will investigate on your behalf.
Personally, I would suggest waiting for their response before considering legal services. If the case does go to the Ombudsman, I believe there’s a strong chance they will find in your favour after considering both sides.

However you composed your letter, it is very well written. One final piece of advice, even when faced with deeply unfair treatment, it’s always best, in a formal complaint, to avoid including any emotion or personal opinions. A calm, factual approach ensures the focus remains squarely on the breach of the Equalities Act, which will only strengthen your position.
Also, don’t fall for the “we would like to phone you to discuss it” tactic. Make it clear that all matters relating to this complaint must be conducted via email. You can request this as a reasonable adjustment under the Equalities Act 2010. It’s essential to leave nothing to chance. By documenting all responses, you’ll have a clear paper trail of exactly what was said. Written words leave less room for misunderstanding compared to spoken communication, which can sometimes be open to interpretation.
Have you had the chance to explore the community and other threads? You’ll find that many members have faced situations similar to your own. Unfortunately, not everyone has had the strength or determination to pursue a formal complaint, as the process can be exhausting and disheartening. Take care and good luck.

Yes, I only do emails, in these situations, and tend to push any daily dealings I have with companies, departments to communicate via email as I have learned the hard way over the years.
I have to leave in the bit with the universe, this has to be said, part of my condition and is a fact, nothing more, and maybe one or two people it may well **** their mind on the job they have been undertaking for money to make other humans suffer with their narrow vision on disabilities.
I have been searching on the community, but find the indexing pretty hard to find what I am looking for, it appears there are a few similar situations from people like me and the way they have been treated.
There is a great content creator on YouTube and ticktock, called ''the Justice Journals'' she previously worked for the DWP and is disabled and took them to court and won, she has just been going over the green paper today, it would be good to get some sort of link on this site to her content, as it is super helpful, and she covers all benefit related content daily, check her out if you do not know of her work.
I will be getting in contact with her soon, in relation to all of this, as her company helps with legal matters against the DWP.
This is not something that I wished to do raising the complaints but needs to be done, cannot take any more of their inhumane tactics & breaches of my human rights and the equality act towards my lifelong conditions. I am fearful that they will be underhand in this and will try and make my life even more of a misery, it is either fight all the way and get the result or I will no doubt be in a coffin before too long,

Because they are a private company does it mean I cannot express the truth? the facts?
They are contributors to this inhumane treatment, along with Atos another devil company, these are facts, you can find online, along with seeing the ill-treatment of others in their buildings along with their disgusting treatment towards me over the years, I will continue to put my words into universal energy to all that work for these companies in the hope some of them can see the light, the universal balance is real, I see this daily, what you put in you get back, ying and yang, duality,

No need to worry about me Summer, I have seen with my own eyes the blinded devils have their day, I say this in the hope they can see the light and gain some love for their fellow humans, if not I have done my part, it is sad to see, but we all have our choices to make and if you work for these devils it will come back on you ten-fold with the bad energies you are putting out there all for money, and the classic line ' I am just doing my job' 🤣 I tell them well your job entails the mass demonization of the disabled and you have a hand and play a part in in the process of killing people, maybe you should think about a career change! have to say what is on my mind that many do not like to hear the truth or their bubbles burst, well it is in now, let the fun and games begin, either I am getting the result I wish for or I will be in a box, taking no more of their practices towards me or others,

Summer everything you have stated has been done to me and many others that I have witnessed, my guess is that it was the ATOS company who did this to you,
yep the dreaded letters, I feel the same when one arrives,
The assessments are not assessments, they are deceitful and try tricks on you like it is a game, as we know the universe will punish all of these people and more, I have seen with my own eyes, firsthand and some of these people are now suffering more from their actions, what you put you get back :)
You keep strong as you may not know and you are a fighter and a good soul, you have come this far, and have done so well :)
Do not get me started on ropey GPs, dodgy mental health, etc, they are not there to help they just gaslight and do nothing for you except try to make you worse along with pushing their crappy drugs on you, I avoid these people at all costs,
Am the same with the Clowncil where I am, and the previous place, another department bashing the disabled, am taking my Clowncil to court due to their years of failures towards me, they think they can treat people how they like, not on my watch! Make sure you put in any complaints to yours if they are messing you around, use chat gtp to review their letters/email etc to see if they are breaching your rights, and to compose letters stating the breaches for the complaints, it may seem much to do, but it will help for a stress-free future for you in the long run, it is really easy to do and quick on the chat gtp, :)
