Hello everyone I'm paul was wondering if anyone has had the same problem as me regarding UC payments. I applied for UC on July 3rd moving from income based ESA which I have been on since 2017. Since then no payments of UC lcwra only ESA new style I got someone from citizens advice to ring them and they said I haven't awarded me lcwra and said I have to do a wca and yet previous to this my advisor from UC said I didn't need to send in a fit note. I have complained in my journal a week a go and no reply struggling financially now

Poor advice from UC staff is common, they are poorly trained and do little more than reading from a screen in a call centre.

It's not unusual for the first UC statement to be incorrect.

If you moved from ESA Support Group then you are entitled to the UC equivalent, LCWRA automatically without needing to submit Fit Notes or have an WCA.

Sometimes the LCWRA element is missing from the first statement.

Unfortunately all you can do is highlight the missing element and wait for your award to be corrected.

You'll know when this has been done as a letter will be added to your Journal stating the amount owed due to underpayment. The money will then be paid within a few working days. A new version of your statement will be added.

Your award before deductions will increase by £423.27 if you migrated without SDP. That leaves( with the New Style ESA deduction) £214.36 a month UC would be payable.

If you migrated with SDP you would get an additional amount of money called Transitional Protection. TP is added if your total UC award is lower than legacy benefits at the time of transfer. This does erode over time as other elements go up or new elements are added to your claim.

In short your award before deductions would match your legacy benefits.

As you've been waiting a long time, you could make a formal complaint

Hi Kim thanks for your input so basically instead of 140.55 a week I should be receiving £205 75 a week then? And they owe me £520 for the 2 months of unpaid UC then

Hi Kim/ everyone finally heard back from uc they said they are waiting to hear back from ESA before they can reassess my award any idea what that means?

It means that UC need ESA to confirm your status at the time of transfer (Support Group), so they can apply the LCWRA element to your claim.

Unfortunately this process isn't automatic as ESA uses an ancient computer system which can't easily talk to the one UC uses.

thankyou again for your reply does that mean I won't need to do a wca then? Once they have they have established this that I am in the support group

No you won't need a reassessment as a direct result of moving from ESA to UC.

Once ESA confirm your status then the UC equivalent (LCWRA element) will be applied to your claim automatically.

Hi Kim thanks again for replying as I have been worrying as I've lost my pip from a assessment. ( currently appealing pre tribunal date) and was worried about another one on UC.. so instead of being on £288 fortnight once the lcwra is added it should be £411.50 a fortnight then? Total £823 a month

Your overall income should be £823.41 a month.

ESA accounts for £609.05, the rest will be paid in Universal Credit.

I had the same problem. This is what you can do . Call Esa old style phone line . Advise them that uc haven't updated lwra during uc migration and your in wrong group. Ask esa to send uc an email with esa informationand group you was in. Log time call and advisor name and they can do email whilst on call . Take snap shot of call log. Then call uc advise email has been sent and confirmed with all details from previous call. Agent name time of call and email sent . Ask uc advisor to log on system. As k uc Agent for there name time ext same as call to esa legacy. Snapshot call time put all information on journal explaining regarding both calls and email sent . I had same problem. This is how my status was rectified. You should get back payment. But it will take time
