More information is needed before I can advise.

1/ What date exactly did you provide your first fit note?

2/ What date do you usually receive your money each month?

The waiting period for the LCWRA element is 3 full assessment periods. The extra money is then paid from the 4th month after you provided your first fit note, with first payment being the end of that month. It's not paid at all during the waiting period.

If there were gaps in your fit notes this can affect when the extra money is paid from.

    LCWRA is £416.19 per month.

Backpay usually takes at least several weeks to calculate and send (separately to your normal monthly payment).

LCWRA has a waiting period of three full assessment periods, from the date the first Fit Note was handed in. No money is paid or subsequently owed for that period.

If you can give some more details one of us can do a timeline for you, so you know how many months you are owed.

The date you handed in your first Fit Note

    Any gaps in Fit notes?

    Your assessment period date.

    Hi,

Can you check the date that you provided the first fit note to UC? And also the dates of your UC assessment periods?

The LCWRA element is £416.19 a month.

For a very rough estimate, you should be getting around 6 months worth of LCWRA backpay which works out as just under £2,500.

However, if you were previously receiving the Carers Element of UC, or you had Transitional Protection after moving from legacy benefits, then the amount of backpay will be much lower.

my 1st fit note was November last year

I receive UC the 8th of the month

My assessment period dates are 2nd of the month to the 1st of the month

I’ve only just had my WCA and got a notification in my journal today that I have been found to have limited capability of work and work related activities

I'm sorry but we will need to know the exact date you provided that first fit note? Without knowing that we can't advise you. You can check back through your journal to see what date it was.

my first fit note was 8/7/2023 with a break from 28/2/2024 to 5/4/2024 as I tried to go back to work and could not keep the job then fit note submitted 5/4/2024

You first said it was 9 months and then from November last year and now saying it's from July 2023.

The gap in your fit notes will likely cause an issue and they could start the waiting period from when they were continuous, it will be down to a decision maker to make the final decision.

If there were no gaps from 5/4/2024 up until a decision was made then your waiting period will be as follows..

2nd April to 1st May doesn't count because you provided that fit note in the middle of the assessment period. It has to be 3 FULL assessment periods.

    2nd May to 1st June.. 1 month

    2nd June to 1st July.. 2 months

    2nd July to 1st August.. 3 months

LCWRA starts from assessment period 2nd Aug to 1st Sept and first payment will be 8th Sept. Any money owed will be paid as a separate payment and often takes quite a few weeks to pay it.

You will need to check your next statement to make sure the element is included.

Because there was a break in Fit Notes, a Decision Maker would need to decide when to start the waiting period from.

Assuming they apply the LCWRA from April:

April/May AP: Fit note provided *partial AP not counted for waiting period *

    May/June: AP 1

    June/July: AP 2

    July/August: AP 3

    August/September: Eligible for LCWRA

    September/October: Eligible for LCWRA

    October/November: Eligible for LCWRA

If they add LCWRA to your next statement you'll receive an extra £416.19 on 8th December, with two months (£832.38) owed.

If the decision is made quicker than it was for OP, then no backpay is owed, due to the waiting period where no money is paid.
