@poppy123456 I had a chat with a manager from pip today everything you have said about not getting back pay is correct eg if the review was started by dwp then no back pay would be offered.
But he did say it wouldn't surprise him if in the future the rule not to pay backpay from reviews could be over turned so fingers crossed it happens.

This doesn't excuse the fact that some receive it while others don't. In my opinion that's unfair and i have no idea how they decide who does and who doesn't receive it.

The manager stating if the review was started by the DWP no back pay would be offered is incorrect.
I can confirm with complete certainty that the DWP initiated my review. Under no circumstances would I have willingly subjected my claim to a re-examination, as I would have been concerned about the potential removal of my standard daily care award.

In normal times that would have been correct. The reason some are receiving money owed is because of the delays with decisions for reviews.

It's very strange @MW123 none off what they are doing makes sense as @poppy123456 says.
When they say theres no backpay if dwp started the review what difference should that make as PIP start all the reviews when it gets near to the end off an award the fact its taken solong is not the fault off disabled people.
If my review had been done on time which would have been January 2022 I no I would have been on enhanced rate from then but no the decision maker has decided I'm only entitled to enhanced from July 2023.
Like I've said I'm very grateful for my award but I feel PIP have robbed me of what I should have received going back to November 2021.

Your existing award will continue until a decision is made on your review. If it’s a review started by DWP and your awarded a higher rate then they don’t always owe any money either. Some are owed and some aren’t.

It’s not a review, it’s a tribunal win. My next normal payment is the 17th, and backdated payment which was confirmed by DWP is after my normal payment!!

You didn’t mention that in your question! Money owed is always paid separately to your usual 4 weekly payment.

I’ve finally found out what’s happened pip have got a hold on £1400 until they see if there is any money to go onto any debts with dwp I explained  what the money was going to be used for and he said he will get it paid back to me. So it’s just a waiting game now.

If you haven't already then you'll need to speak to debt management regarding this because it will be those that deal with the debt repayments.

    Hello anth22

I absolutely understand why you feel you have been robbed; I think you have every right to. I genuinely empathise with your frustration and disappointment.

It's truly disheartening to learn that the DWP has the authority to grant retroactive payments while selectively denying them to others in exactly the same situation.

This lack of transparency is certainly sufficient to evoke feelings of anger and disillusionment in anyone reading the posts, let alone someone like you who is a victim of it.

I know it is of little consolation to you now, but it seems apparent that someone will call them out on this injustice, and they will eventually be obligated to reimburse the deficit to all those who were affected.

It’s been sorted now they are transferring the full amount back into my bank account within the next 3-5 working days. A wonderful lady in dwp debt management on the phone did everything for me and was so helpful and understanding x

    Hi,
I just wanted to say that my review was started by Dwp in April 2022 I sent back the form, as my previous claim was coming to an end. My claim has now been completed. I was pr
eviously on just Standard rate for daily living and previously got nothing for mobility.
However after this assessment I have been awarded high for both components. My health has been horrendous lately since Dec 2021 and I have had a few hospital admissions. I was awarded back payment from when they sent out the form in March 2022. They decided to pay the high rate from then. It was a big shock to receive a lump sum in my account! as I was not expecting anything a back pay as they started the review. What shocked me was I got a call from dwp to ask if I can manage the back pay? I asked how much and they said just £2100. I asked what that was for and they said the difference in the back pay from 2022. They said clearly I wasn’t due anything else. I didn’t question it any further as I was grateful  appreciate any amount. He said it’s Thursday today and the money would be in my account by Tuesday. I checked my account on Tuesday and speechless as there was a payment of over 4K which came on Monday from Dwp!.. There was no amount that he mentioned of £2100. So I called up dwp ASAP as I thought there was an error and I didn’t want to be liable for an overpayment. They checked the system and said there’s nothing on their in regards to the amount I got, other than the £2100. I told them that is what I’m expecting and not the 4k. They said oh you are still due £2100 and it would be cleared by tonight as it’s Tuesday night. I was now even more confused!… They said to wait till I get the letter and that a manager will call me. The manager did eventually call me, he explained that the 4k was for the arrears for high rate mobility since April 2022. I was ever so grateful as iv been struggling lately with my health and started to dig into my overdraft. It has taken a long time for them to finally award me what I believed I was entitled to. For my previous claim I did ask MD which didn’t change anything for my award and I was not in a fit state to appeal it physically/mentally. My previous award was lover looked and they didn’t consider my evidence. My conditions are still the same as my previous award. I didn’t question why this time round it was different. I’m assuming it’s due to the hospital stays and during my assessment I couldn’t talk as I was very wheezy and out of breath. It’s very sad that they put people through this when they are already dealing with poor health. Sorry for this long essay but I just wanted to say that it is possible to get back pay even though dwp start the review. I’m thinking the only reason they decided to award mine as I called up in Jan 2022 to say my meds have changed and I was in hospital, the call assist said no point stating the change of circumstance as I’m due for review anyway in Mar 2022.
I hope and pray everyone gets what they are entitled to and deserve… I know reading this msg it’s not going to make anything easier for anyone but I honestly hope it helps in any form possible…Patience is a virtue!… xx

    Hello meenabudd

I like you was surprised to receive backpay and also have my award elevated from just the standard daily living to enhanced for both I truly was not expecting that.  This back pay is now bittersweet for me after reading anth22’s experience.

In 2018, I initiated my PIP application and received the standard daily living allowance until 2020. The review in 2020, I  managed to keep the same award. I chose not to dispute these outcomes, as I felt appreciative I had received something, considering that numerous individuals receive no award at all.

In March 2022, I received review papers for an upcoming review for February 2023. Similar to your situation, I experienced a hospitalisation Autumn 2021. I was scheduled for spinal surgery to address spinal damage, a stent placement in my leg to enhance blood flow, and heart surgery to rectify aortic stenosis in my heart. However, my oncologist, who leads the medical team, decided to stop  any further medical procedures due to my deteriorating condition. By that point, I was grappling with heart failure, and the progression of my blood cancer made it improbable for me to survive any surgical interventions. Since  2018, I have consistently provided the DWP with consultant letters pertaining to my medical conditions, particularly those that highlight the way these conditions impact my overall quality of life.

The main difference in my approach this time, as opposed to before, was my incorporation of Poppy's valuable advice and wise counsel. By closely following her posts, I came to realise that in previous instances of completing the forms, I had completely misunderstood what was required to meet the descriptors.

@meenabudd and @MW123 I'm pleased you both got what you deserved in your awards the only grudge I hold is with PIP this comment from them is absolutely ridiculous, no back pay due to them starting the review not being funny but what review do they not start lol.
I've emailed my MP hopefully he can get to the bottom off this as soon as I hear I will post his reply.
