Universal Credit/ LCWRA /TP

Please could someone help me. I’ve been migrated to UC with TP I was told I needed to get assessment for LCWRA which was awarded. However my recent payment with this is £198.33 less than my previous TP payments. They have taken the LCWRA amount off my TP and taken away Carers element. Is this correct I was under the impression it would be the difference between the two it would be reduced by ? I have tried contacting them via journal but no response. Any advise greatly received

Under UC you can't have both LCWRA & carers element at the same time.
The highest element is payable, so LCWRA, and this is why your TP has been reduced by the LCWRA amount.

thankyou I’m aware of that however they have taken both amounts away from me and I saw previously it should have been the difference between the two

Yes, unfortunately this is correct. Although I think it's wrong that they do this. There was supposed to be an Upper Tribunal hearing for exactly this on 30th October but I haven't yet heard if that went ahead or what the outcome was.

Thankyou it’s so unfair as I was forced to apply for LCWRA I was happy with just carers element. Hopefully tribunal will overturn this! Is it worth me asking for reconsideration?

Until the outcome of the Upper Tribunal on the matter is announced, a reconsideration will not change the outcome as they have applied the guidance correctly.

thankyou I saw on another forum someone from shelter advised should request reconsideration or appeal to avoid issues later if tribunal is successful. This is all so stressful and confusing. They really should be making people aware of issues with claiming LCWRA if you are on TP
