    my niece contacted me yesterday--her tribunal hearing was yesterday and she was waiting for cab girl outside and got a phone call to say she had not turned into work and no one could come to represent her---------she suffers from bad depression and other things-total panic set in--she said she only had about 5 minutes to gather herself before going in-she said solicitor gave her a hard time with line of questions but she said she totally fell apart and got into a total flustre-she was turned down and is totally devistated--(they gave her some points-havent seen  sheet or report they gave her as she was crying non stop on phone shes to call tonite(-pip gave her none at all)----i suggested a completely new pips claim? can she do this? ---how long does she have to wait before she can submit this?   she said she has learned an awful lot from both pips assessment and tribunal and will pay someone next time to speak on her behalf------anyone advise on this shes really mad at cab

    I'm sorry to hear that she was let down.

    For the Tribunal yes, she has 1 month from the date of the decision to request the statement of reasons and record of proceedings. Once this is received she'll need to find someone to take a look to see if an error in law has been made, if it hasn't then she won't be able to take this claim any further.

    There's no timescales to when you can re-apply but using the same evidence that was previously used will likely see another refusal.

    Unfortunately, during an assessment and a Tribunal they will expect for you to speak for yourself, unless you have an appointee. Even with representation they won't be able to speak on your behalf. This means that she won't be able to pay someone to speak on her behalf.

    ill download this answer and give it to her-she did say solicitor quizzed her -was she sure the assessor did not identify herself by name or showing her  badge (she definately didnt-this happened to me as well it was the same girl-i think shes polish disability action knew of her and had complaints about her over a 7 month period)  she said she didnt think so but he kept at her she either did or didnt-im assuming there is some point of law here but thanks for ur help poppy123456  ill show her ur reply----some of these people who come with u and u pay are giving the impression they can speak for u which u say they cant good to know this for my own appeal which im told by omagh will be at least 6 months away

    dfc have stil not received my repot from capita, it went to audit at capita but they z they sent it just over a week ago but still not with dfc so I don't know where it is. 5 weeks today from I had my assessment. so stressful

    I had my f2f 2nd July. Rang a week and a half ago and was told it was in a queue to be allocated to a decision maker and will be allocated within 2 weeks.  I also asked for my report and she said it would be sent out within 2 weeks so should be here on Thursday. Does anyone know how long I should hear after it is allocated to decision maker.  First time I've applied so don't know much about all this. Thanks

    Hi,

    There's no timescales for decisions, it depends on backlog in your area. Once you receive the report, check the dots in the back against the PIP descriptors and it will tell you if there's a recommendation of an award or not. They usually go with the report. Hopefully not too long.

    I'd advise you to ring Capita again because you may have been advised incorrectly. Once you've rang if the advice is still the same then ring DFC to check it's finally been received. There's 2 reports that need to be received, a digital one and paper one. The paper one takes longer naturally.

    Just checked my bank and have a pip payment in but can't work out what I've been awarded. I've tried all combinations and it's not working out. Is it backdated to the 1st phone call requesting application form or is it the f2f date or is it just 4 weeks. Sorry for all the questions. Thanks

    If you haven't transferred from DLA and it's a first time claim then it's from the date you rang to start your claim.

    Rang DWP today to see what I got awarded. So happy as I got enhanced mobility and standard care. 1st time I have applied and didn't think I'd get anything. Must say guy on phone was so helpful even telling me about other benefits I would be entitled to as I work and have children.

    Got result of my review today nothing changed still only got standard rate. Spoke to pip and they told me that reviews very rarely change original decision and that's why there is an appeals process!!! So why have it. My assessor said I had never been hospitalised so I sent in the proof I had been in hosp 22 times and they completely ignored it. I use a wheelchair assessor said I use a mobility scooter I sent letter from physio proving that was incorrect again ignored it. Lodged complaint with capita also and they say can't investigate as assessor no longer works for them. I'm abs raging. Missed mobility by 2 points which my evidence if looked at would have changed this.

    A CANCER SUPPORT GROUP TOLD ME -QUITE A FEW ASSESSORS HAD NOT RENEWED THEIR CONTRACTS-WONDER WHY?

    Dfc finally got my capita assessment after 6 weeks due to it going to audit. my claim is with dm at the minute, so anxious, just cant wait til its all over and I hear back from them. so stressful. really hope everything goes ok

    thanks. yes I did request it today, they z they wil send it but I always thought I had to wait until a decesion had been made before I could get a copy

    That's usually the case if you live in N. Ireland. If you live in the UK they will send it.

    I received a copy of my capita assessment, but still do decision on my claim yet, I matched what the assessor recommended to points table of pip but im not really sure if the decision maker will go with the assessor's report. its not really what I hoped for if that does happen but I think its fair if im being honest, will just have to wait and see what happens
