WCA consultation ruled unlawful - White paper, part 2

Jane please don't take this the wrong way, but your last few posts have put fear of God into me. Have you evidence? I know Catherine 21 also worries about what's happening. So it's better not to speculate until we get the white ,green paper.

one example is in 2016, Damian Green tried to axe the ESA support group, it backfired hugely and it got dropped.
Something clearly was changed as evidenced by the following -
The DWP’s public consultation also failed to mention that
recent years have seen falling use of the “substantial risk” regulations.
One of the DWP’s proposals is to restrict the use of these regulations on the basis that “they are no longer meeting the original intent to be applied only in exceptional circumstances”.
But an internal graph released by the DWP as part of the judicial review proceedings showed that
the proportion of decisions that were due to substantial risk had peaked in 2015
and was now as low as it had ever been back to when the WCA was introduced. This data was available to the DWP but not to the public, and the downward trend of cases was not mentioned in the consultation document.
The DWP’s plans cut the number of people qualifying for the highest rates of disability benefit via the “limited capability for work or work-related activity” (LCWRA) group.
Disabled people in the LCWRA group do not have to undertake any activities related to finding work, whereas those assessed as having “limited capability for work” are expected to undertake activities preparing for employment.
Those who don’t qualify as either LCWRA or limited capability for work (LCW) are
effectively assessed to be non-disabled

The Independent Living Fund was axed in 2015.
DPAC was formed as a result of this. Ellen Clifford has been banging on since then (as have I).

This feels like a huge victory!

DWP has lost numerous judicial reviews in the High Court.

@Andi66 I'm so sorry I will try to be more positive and look at the optimistic press and will not comment anymore negative opinion as I can see how sharing my own fear is generating more.I do apologise

What is non disabled classed as pls

UC describes us as "disabled jobseekers"

There will be a new consultation but this time with the facts in front of us thanks to EC.
When they took office a few months ago, Labour published all the buried reports which DWP and the Tories did not want us to see.
We need to separate fact from fiction because none of this is new.
1 -
The cap on claimant numbers migrating to UC was lifted and the UC programme accelerated in May 2024.
I don't know what this PM can do to stop any of it. A cabinet reshuffle is our best hope.
1 -
Yes as many have said there is hope and whilst there is we must not give up as what is right always wins through ultimately in the end.Its easy to get despondent as I have been and perhaps that's what they want. But we must keep the faith

the proportion of decisions that were due to substantial risk had peaked in 2015
and was now as low as it had ever been back to when the WCA was introduced (2008)
We still need to understand what impact the 2016 Welfare Reform and WORK Act had on the assessment process and benefits decisions.
Ellen Clifford has ensured this farce won't be forgotten or buried under "new rules".
1 -
I wish esa migration would be pushed back, especially as they are now dealing with pension credit influx.

I think personally any changes they try and do won't take place till the next government anyway, which wont be Labour, it will be a Reform government, and godness knows there plans.

Labour want to cut that 3 billion the Tories pledged to cut, it's baked into treasury numbers.
So how are they going to do it?
0 -
Ah I see yes you was saying this a while back just wondering how made it with the changes back then my last lwcra assignment was 2020
